Discussion about rule 6.3.2 and the use Deepfakes for intimate content
This question from @ChadLifter deserves its own thread:
This isn't legal advice. Deepfake technology is indeed new, but the law addressing it isn't as much of a grey area as people assume. The TAKE IT DOWN Act (signed 2025) makes it a crime to publish, or even threaten to publish, non-consensual intimate imagery of a real, identifiable person. That includes AI-generated ones. It doesn't matter if you're profiting from it, if the person is a public figure, or if your intent isn't "revenge." It also doesn't matter if you label it as AI-generated or add a disclaimer saying it's "not real", none of that changes whether the depicted person consented, to my understanding.
Most U.S. states have their own laws on top of this, and other countries have similar laws too, so this isn't purely a U.S.-specific issue.
So to answer your question, given the above, our policy is: we remove any intimate deepfakes of real, identifiable people unless we have explicit consent from that person.
If you want to create intimate AI content, don't base it on a real, identifiable individual, as outlined in rule 6.3.2
