I want to make an AI video of this [allfather note: a real person]. Is that allowed? I'm pretty certain it's fully legal, the grey area is when it's used as revenge porn, and when the maker is profiting off of it/selling it.

Can I make a video of this and post it in the new NSFW AI section with some sort of AI tag, so that it's clear it's AI? Or maybe it's obvious because it's in that section, but I could also just write a post "for personal use, not real" or something?

This isn't legal advice. Deepfake technology is indeed new, but the law addressing it isn't as much of a grey area as people assume. The TAKE IT DOWN Act (signed 2025) makes it a crime to publish, or even threaten to publish, non-consensual intimate imagery of a real, identifiable person. That includes AI-generated ones. It doesn't matter if you're profiting from it, if the person is a public figure, or if your intent isn't "revenge." It also doesn't matter if you label it as AI-generated or add a disclaimer saying it's "not real", none of that changes whether the depicted person consented, to my understanding.

Most U.S. states have their own laws on top of this, and other countries have similar laws too, so this isn't purely a U.S.-specific issue.

So to answer your question, given the above, our policy is: we remove any intimate deepfakes of real, identifiable people unless we have explicit consent from that person.

If you want to create intimate AI content, don't base it on a real, identifiable individual, as outlined in rule 6.3.2

I can inform you that user N0rds, is in violation of this federal law with his postings of user mariomiami's AI photos, depicting sexualized content with digital/AI semen placed on Mario's face on AI images. This user N0rds has generated DOZENs of these illegal images and posted them ROUTINELY on your site.

I will be on the look out and report immediately these images

I knew they were distasteful but I didnt know they were violating US federal law.
