Free speech only applies to a citizen's criticism of the government. Michelle as a private citizen can sue him as many times as she wants. And given that the Obamas are wealthy and have a huge following, she will win.

Of course if the jury is liberals they will just.side.with her

While not sworn in -- I wouldn't say she's not in the politician circle. She's campaigned, gave speeches, influenced policy, etc. Somebody like Bush's old lady is more what I'd call "not a politician" because I don't hear anything about her.
