Misc lawyers, need advice. Work basically bullying into getting vaxx. wat do?
This week HR sends an email saying if you show proof of getting vaxx by "x" date you will get a $200 gift card. I was livid.
Some background info to put into perspective. It's a retail store with 12+ locations and a big warehouse together with the offices. I work in the main offices (about 40 people) 20 of those like starting level physical labor that would jump at the change of an extra $200. And I have been working here for 17 plus years since the start and have a high-level position. I have literally been in meetings with owners about how legally they can require it or force and brainstorming how to handle it. You already know my position on it based on this thread. Literally, now I'm the only one from the owners and main managers that isnt vaxx and instead of getting into the debate just say I havent had the time.
Is there any legal implications in this strategy? Literally feels that its just a clever way to know and have a list of who is and who is not vaxx, since they cant legally demand or ask for medical history that doesn't affect work duties (correct??) Also I know only about 4 other people who will not get it. I feel like this would literally alienate and discriminate against those who dont get it. I having a high-level position worries me how to handle that I won't get it and how quickly in my position I can be shamed like those actual crazy conspiracy theory cause autism antivaxxers.
Is this even legal? Are there any grounds to fight?

Tell them you rushed and traveled to Mexico to get the vax back in February because you couldn't wait.
Tell them you had both doses, pick whatever brand you choose. Tell them you can't take an additional dose because it doesn't make sense, but that you are fully vaxxed

Tell them your getting vaxxxed one evening, then call in the next day saying you have really bad chills. Take a few days off...then tell them you tried all kinds of meds and drank enough rock and rye to tranq a silverback and must’ve lost your vaxxx card. Problem solved. You get some days off and give them the illusion your vaxxxed and also make them feel like chitheads for making you sick. Win, win, win situation.

The $200 gift card is a REALLY sneaky way of forcing your employees to get the vax. Whoever doesn't claim the 200 essentially admits they didn't get the vax.
Per OSCHA regulations you can't force your employees to get it and if you do the company is liable for side effects.
Just tell them you've already had covid. You shouldn't be forced to show antibodies per HIPAA health privacy.
Pretty much everyone at my factory had covid during the outbreak and we're fine. We just had one man get the vax (after already having covid) and he passed away from a heart attack last week.
I'm telling you from personal experience the vax is more dangerous than covid.
Last note: I've had covid and if you donate blood to red cross they do a free antibody check. Takes about 4-5 days for results. Just make sure to create an account on the app before appt. I still tested positive for antibodies 5 months after diagnosis.

About 50% of the people at my company who got the vax were fukked up for a couple days.

The law is now irrelevant. Being vaccinated is the holiest sacrament in the land. Highly unlikely any court will rule against vaccination in any circumstance.
Just find a way to get the proof without actually getting injected. Lots of independent pharmacies/doctors out there who don't care.

Not a lawyer, but currently looking for work and if any employer brings that up and pressures me, I will not work for them. Period.
I know that's probably not always an option, but I'd rather look for work, then take something I do not trust or believe in.

How far out is the deadline? Can you "schedule" it so that your second shot of the Moderna vaccine, which you need to wait 4 weeks for, is past that date?
You don't want to bring your card in because you don't want to lose it before your second dose. After the second dose, you're worried about damaging the card because you're waiting to get it laminated. What if you need to use it for a flight????? Make sure to mention the lamination part several times to anyone that asks.
Management may possibly already heard of people's (hopefully their wife's/sister's/mother's) intentions to laminate their card. The response you're looking to hear is that you shouldn't laminate your card because you might need a booster shot. Better keep that card safe, like in an annoying to get to fire-safe with your other important documents.

Since your employer is a private actor you have very little legal standing to refuse a vaccine if you would like to remain employed. Florida also has at-will employment so you can be let go for essentially any reason that does not violate something like the ADA. The EEOC already concluded that requiring the vaccine does not violate the ADA. The only thing you can do is prove that you have a medical or religious exemption. You can also request accommodations (like PPE) or to work from home- your employer does not need to honor these unless you meet the medical exemption. Do not fake a Covid Vaccine card- that is a federal crime.

I'm Hispanic and have had plenty of vaxx thru my life even including smallpox whose scar is on my shoulder and have vaxx my own offspring. My concern is the legality of a business incentivizing to get "x" medical procedure basically paying to volunteer your private personal medical history. This will only serve to technically always be judged by the clown world of public opinion. 2nd question was; how I can save face If I wont get it and my reputation be diluted to a crazy antivaxx Karen.
My own mother is on that 1% of high probability of death and after several blood test they keep telling her to not take any of them. The only ******* who doesn't think his actions don't affect people and the greater good is you. Kinda sheep ******* that would do great in 1940's Germany.
