I think this will accomplish what they wanted either way it plays out:

A. The $10k is forgiven and money is funneled to the lenders, people with debt temporarily happy they owe $10k less, just in time for the elections.

B. This is blocked, and those same people associate it being blocked with the opposing party, just in time for the elections.

Lenders will get their money either way since you can't declare bankruptcy on these loans.

If this does get struck down by the supreme court, it will be well after 2022 election. Maybe around 2024 though

Here is some actual legal analysis:
President Joe Biden’s long-awaited student loan forgiveness plan might be dead on arrival after the Supreme Court effectively hobbled the administrative state this past June when it comes to making big political and economic action without congressional authorization.

“I think when we were all considering the legality of this kind of an action, we were doing it before the EPA decision in June, and so there's been a lot of back and forth over who thinks it's legal or not but that really changed the standard,”

....

Split along party lines, the conservative majority leaned on the major questions doctrine to strike down the EPA’s regulatory scheme. This doctrine says that explicit authorization from Congress is necessary if executive agencies are taking “major” actions that will have large economic and political significance.
https://www.courthousenews.com/stude...cotus-problem/
A recent Supreme Court decision that limits the Environmental Protection Agency's ability to fight the climate crisis could also hamstring President Joe Biden's authority to cancel federal student loan debt....

But the Supreme Court's June ruling in West Virginia v. Environmental Protection Agency, which curbed the agency's authority to set certain climate change regulations, could now add another factor to the Biden administration's decision-making process.
.....
But if the major questions doctrine comes into play, courts may find that if Congress had intended for the authority to be used in such a sweeping manner as to broadly cancel student loan debt, it would have said so more clearly in the statute.
....
Luke Herrine, an assistant law professor at the University of Alabama who previously worked on legal strategy pushing for student debt cancellation, also said he believes that Congress has given the Department of Education "multiple powers to cancel student debt." But given the recent Supreme Court decisions, Herrine could see the current justices striking down an executive action to broadly do so. Traditionally the courts have deferred to the federal agency when issues arise concerning an ambiguous statute. But there has been a shift.

"To me, the courts are basically saying, 'We're going to have the first say,'" Herrine said.
https://www.cnn.com/2022/07/24/polit...ans/index.html

CLIFFS:
- SCOTUS made up something this summer that gives them the ability to say broad executive actions are unconstitutional
- Lawsuits incoming
- This SCOTUS is actually potato enough to overturn Roe v Wade, they will absolutely overturn this executive action

CLIFFS OF CLIFFS:
- Today studentloancels are buying champaigne
- Tomorrow they will be buying rope

This is a very good point. As the sources state, the legal analysis for Biden's authority to do this was pre this made up SCOTUS chit from this summer. BUT, they obviously know about it now and went forward with this anyways.

I think you are exactly right. Biden and his corporate sponsors gets to have their cake and eat it too.

I just hope SCOTUS is judicious enough to wait until after midterms to strike this down.

I don't think so. I'm not a litigator, but I'll bet they file for a temporary restraining order / preliminary injunction, which will likely be granted (because if loans are forgiven, they are not going to be able to say JK in 2 years and add it back to ppl's balances), and the case will get fast tracked through the legal system; meanwhile, student loan forgiveness can't actually happen until there is a final non-appealable order.

Only Congress has the legal authority to delegate to the Dept of Education the ability to legally forgive the loans, not the President, since it requires spending money that has not been previously allocated for by Congress.

Not banks, the federal government (this is federal loans only, not private). The Department of Education holds these loans.

The issue is that the Executive branch doesn't have the power to appropriate money. That's solely a power of Congress. And "forgiving loans" is essentially appropriating additional funds to the balance sheet of the DoE. Alternatively, you could look at it like the Executive branch is levying a tax on everyone in the US to pay the balance of the loans.

You're looking at it like "the government" is one monolithic organization. Apparently the education system has failed you in learning what the branches of government do, and why their powers were separated.

Nah, the money has already been spent. The Govt has a receivable now from those students for that debt. Biden isnt spending money, hes cancelling those obligations - a write-off.

In other words. You loan your friend 100 bucks. After he helps you move you say, you know that hundo you owe me? We're sweet bro. It doesn't cost you anything to forgive that debt.

You are dumb as a rock. It's simply debt redistribution.

The government doesn't actually make any money. It's only source of income is tax revenue. So they can't actually "forgive" debt as they aren't taking the hit themselves out of their own productivity. The debt is simply paid for with tax revenue. Which is produced by the people. This scam is nothing more than redistributing retarded people's debt to smart people. Rewarding dumb people for being dumb and punishing smart people for being smart.

Debt redistribution by the government is not "cancellation" and only the dumbest idiots think it is.

lol love these reddit-tier cope talking points. Education money well spent!

First, it is not a "spend," it is a loan. As you point out, you get a note receivable in return, with an interest rate. A safe investment. You exchange one asset on the balance sheet (cash) for another asset (note receivable).

A "write off" doesn't just magically make things disappear from an accounting perspective. There is a corresponding debit (expense) on the liability side of the ledger when you write something off. So you can absolutely look at it as an expenditure.

Your analogy doesn't work. In your scenario, your describing forgiveness as compensation for services. Instead of paying cash, which reduces your assets, you are forgiving a loan, which also reduces assets. You come out the same either way.

In any case, none of the above nomenclature(about which you have absolutely no grasp (quality education at work))is even at play here. This is a legal issue, not an accounting issue. The legal issue is whether exec branch can unliterally take broad and sweeping actions that are ostensibly within the purview of ageneral mandate from congress, without aspecific mandate from congress. A SCOTUS case this summer struck down a similar executive branch action. So the big question is will this get struck down for the same reason.

JFL if you think the SCOTUS that had the audacity to overturn Roe v Wade (which was totally potato move by SCTOUS, IMO), won't strike down this forgiveness.

Dam* this is such a nut punch I didn't even think of

So not only do those who didn't take a loan out [potentially] not get free money, they then get punished by the deleterious effects from those who took them out stupidly and can't pay them. So, double the repercussions at least

I'd be shocked if it's not struck down

Add on top of that that the forgivecels get an increased feeling of entitlement and feel justified in their complete and utter contempt of the middle and working class who call this out for being unfair.

If I was poor and dumb enough to be a forgivecel, better believe I would be thanking the middle and working class for helping my ass out and acknowledging I don't deserve it, but I am beyond grateful. Not berating them for being mad about having money stolen from them.

Who is the bootlicker, the guy speaking against a dictator-like executive order that takes money out of the hand of the working class, or the guy who is in favor of more and more power being concentrated to a president so that president can oppress others with impunity?

In any case, I am actually trying to help forgivecels out and warn them to not go out and make a 10k YOLO purchase just quite yet....

relax guys, we gave more money to ukraine than we did our own kids...

that money could have gone to tuition, free lunch meals and for general american relief

many people paid their dues and their school loans and not getting forgiveness, who cares, at the end of the day, itll only help those less fortunate who are worried about $ but want an education and those gifted who are disadvantaged to achieve their potential through school so we can find that Einstein or Tu Youyou

our society is way too selfish now, and has the "if I didnt get it, no one gets to either"

"I had to walk 100 miles to school both ways up hill, and if I had to, you have to too son!"

Society is supposed to improve as time goes by, that means if your grandpa walked 100 miles, he worked hard so you (his grandkid) didnt have to walk; think of it like that

A few thoughts:

- this post isn't a rage post. It is a celebration. And also warning for studentloancels not to spend that 10k quite yet, given SCOTUS still has to weigh in
- agree with you on sentiments of domestic spending > foreign spending
- ppl aren't mad because "if i didn't get it.....", and loancels pretending that is the issue is adding fuel to the fire
- ppl are made because this is a shameless buying of votes, it doesn't solve any issues, and it sets precedent for universities to increase tuition and ppl to take out loans in hope of forgiveness down the road
- in any case, all of the above is moot because SCOTUS overturning this chit.
