Free speech at risk in Florida (House Bill 269)


Florida republicucks recently introduced HB 269 following incidents such as flyers, protests on street corners, and a banner held near the Daytona Speedway - much to the chagrin of local authorities who held a press conference on the bill just a few days ago.

HB269 will turn minor misdemeanors such as littering into 3rd degree felony hate crimes with serious jail time if a Florida court finds it was motivated by 'hate'.

In the words of state representative Randy Fine, co-sponsor and author of the bill who is Jewish and a Republican, during the press conference (48:11):
"The way we're going to approach this is through a hate crime kicker. If you graffiti a building, that's a crime now. But if your motivation is hate, it will be a 3rd degree felony, you will spend 5 years in prison. If you want to litter, it's a crime right now. But if you litter and your motivation is a hate crime, it will be a 3rd degree felony; you will spend 5 years in jail. It is a crime right now to hang banners from an interstate for obvious reasons: we don't want to distract drivers. But if you do that and you have a hate motivation, it will be a 3rd degree felony. You will spend 5 years in jail."

Tempted to neg. Free speech is not in any way at risk. They're just adding sentencing depending on intention.

That being said, I think deeming any crime as a "hate crime" is fukking retarded. Unintentional vs intentional, sure, but not differentiating the reason behind an intentional crime.

Reminds me to how they dramatically increased the penalties for crack relative to powder in the 80s to target a demographic.

When the graffiti is a hoax, they won’t get the 5 years because the motivation was to “spread awareness”.
