Daniel Perry Guilty: Drove into Protestors Shot 1

Daniel Perry was found guilty today in Austin. This was during the BLM riots where he made a turn into protestors, then stopped as the crowd gathered and kicked his car. He was approached at his window by Garrett Foster who had a rifle pointed down. The driver, Daniel shot him I think four times then drove off to call police.

I'm not sure how I feel on the verdict.

AUSTIN (KXAN) — The trial for Daniel Perry ended Friday, and after jury deliberation, he was found guilty of murder for the death of a man during a 2020 Black Lives Matter protest.

Perry faced one count of murder and another count of aggravated assault with a deadly weapon after the deadly shooting of Garrett Foster in the streets of downtown Austin on July 25, 2020. While he was found guilty of murder, the jury found that he was not guilty of the aggravated assault charge.

According to APD’s description of the incident, a car turned on Congress Avenue near 4th Street at 9:51 p.m. into where a group of protesters was marching against police violence. Protesters surrounded the car. Foster was armed with an assault-style weapon and was one of the protesters who surrounded the car.

Former Austin Police Chief Brian Manley said that is when the driver, later identified as Perry, fired five shots from inside the vehicle, hitting Foster multiple times. Foster never fired a shot. Another protester then shot at the car three times but did not hit anyone.

Perry and the other shooter were detained by police after the incident. Audio from Perry’s 911 call and video from his interview with APD were played during the trial.

Detectives initially said self defense.
Grand jury chose to indict.
Jury of peers found guilty of murder.

During trial it was shown the rifle was pointed down, not at the driver. The defense tried to say it was pointed up but the Medical Examiners testimony disagreed. There is also a halo street camera that captured it from above but I can't find that video.

Defense said driver slowed down and was lost. Video in OP shows him speeding more than reasonable in a crowd, in my opinion.

Daniel Perry should of killed more BLM rioters. They were not protesters, it was civil unrest.

I have seen the riots in Travis county, especially on 8th street outside HQ. I think the ones who were rioting were given a free pass by the liberal DA Garza

I don't think Garza was our DA at the time.

That was in May of 2020 and Garza was elected in November 2020; so I guess he is currently in charge of prosecuting them.

I don't think Garza was our DA at the time.
You seem pretty level headed. It's fine to open carry, but these rioters were menacing others and impeding the flow of traffic.

From the video I saw it looked like a clear not guilty. You point a gun at someone and they are justified.

If he never had a gun pointed at him... I am a lot more iffy.

Gun stayed pointed down. Defense tried to argue "bladed" position. ME and Halo cam proved it was more like guy on left. Defense tried to argue the below rendering.

According to reports, the AK-47 was strapped to his chest and pointing towards the ground. If there’s evidence he was actively pointing the weapon at the driver that I missed, I’ll gladly re-evaluate.

Openly carrying a rifle is legal. Pointing the gun down is legal. Talking to a person while holding a gun is legal.

So what did the BLM guy legally do wrong to get shot?

It was like a 2 week trial. The Medical Examiner showed that the bullets went through him horizontally, like he was standing sideways. This was key evidence to show the gun was pointed further down. The videos were higher resolution during trial and a halo cam above was shown as well. Talking about the nightlife/pedestrian area in Austin:

Personally for me, a question is, Why did he go down that street through people walking? The shooter was an uber driver.In Austin, those groups of people are common every night; it is a busy nightlife city with lots of people walking around the streets in groups and we have tons of festivals. Whether it is a riot or not, if drive around Austin, youknowto stop for these people and let them walk, riot/protest or not. This is common pedestrian traffic in the nightlife part of Austin.

This happened at 4th and Congress, whether there was a riot or not that area has tons of people at night.

Choosing to drive through a group of people, then being confronted by them with guns, did you fear for your life or did you create the situation?

If the guy is guilty by the letter of the law, I have no problem with this- let's follow laws written.

But afterwards, he needs to be pardoned by the governor for keeping the streets clean.

But he didn’t fire at the crowd or fire warning shots to scare them off. He only fired at the guy he felt threatened by because of the presence of a weapon in a hardcore open carry state.
