Very good book written by Alan Dershowitz about how the federal government essentially makes simply living your life illegal so they can go after whoever they want.

Solid book. I read it a few years ago.

IMO the bigger problem is over prosecution and catch all laws like "obstruction, disturbing the peace, and failure to obey".

Maybe your girl gets her ass grabbed and you punch the guy. You get charged with Felony assault with a max 20 year sentence. Then you later accept a plea for misdemeanor simple assault with 90 days probation.

You are left with deciding to accept the charge you should have got if you lost vs spending 20k and hoping a jury of people side with you.

Semi-mistaken.

The surveillance was enabled via the Patriot act. Most of the broken laws were there before.

Yes when the war on drugs began flooding the courts with criminal cases, especially after Joe Biden's racist 3 strikes policy, prosecutors figured out pretty fast that a way to deal with the back log is by threatening ridiculous sentences so people would just plea out.

If they really want to go after you even if you lawyer up with a top shelf legal team they can make your life a living hell going after you for all sorts of nonsense process crimes once they charge you with something. Doesn't matter if the initial charge gets tossed, they can bankrupt just about anyone with never ending legal expenses.
