The guy i was recording doesnt even care and laughed at the videos when i saw him in the parking lot.

Some real advice:

If they want to get rid of you already they will use this to do it.

Regardless you should do the following:

1. Apologise in writing and in person to the guy and dont pull any punches.

Apology Framework:
1 Acknowledge the offenses specifically
2 Take full responsibility for everything
3 Express genuine regret/remorse (contrition)
4 Acknowledge the impact/hurt caused
5 Offer repair or restitution
6 Explain briefly and commit to change - Sign up to some kind of therapy srs, just find something and tell them you are seeking help to better yourself. You dont have to do it long term but do it now and have appointment details ready.
7 Request forgiveness but dont expect/dont demand it


2. Apologise in writing and in person to your employer the same as above

3. At your hearing show genuine contrition and dont make any excuses, use the apology framework e.g. you know how stupid it was, how it affected others, you want to be a better person and employee, are taking steps to assure change and that it will never happen again.

EDIT: 4. Apologise to the midget.

I hope you get reinstated, but if you don't, I hope you learned a lesson from this and figure something out. We've mentioned it before, but sometimes you let your anger get the best of you and you cross lines, so you need to learn some self control and figure out why you get like that

This is true but the reason i think im cooked is because i dont see an argument they can make to defend me. Its sort of clear cut.

For example theres been many people discharged for drinking on the job bur they fet their job back because they have a problem and they just go to rehab. Theres been much worse but the union can make arguments for them.

Its pretty clear cut. I was recording during work hours and they havd the evidence.

Sucks, but its my own fault.
