You can't prosecute someone for a crime that wasn't lawfully a crime at the time he "committed" it.

I was talking with my parents randomly about family history a few weeks ago and they talked about how it was totally normal in the US at that time (and mostly their parents age) for girls to frequently get married from about 15-18. Totally common apparently and they are talking about the 1970s. just a bit of a stretch. standards change over time but this was a looong time ago
