I've heard of highly illegal practice a lot of gyms do. When people cancel their memberships the gym says ok cool your cancelled and then secretly charge you bs 6 months later and sell it immediately to a debt collector to make money off you.

Op, what happens with those? When it truly is a illegal debt being sold to a debt collector company?

Its unethical but legal. You HAVE to dispute the debt in writing within 30 days of receiving your debt collection notice. If you dont do this, then legally the debt is considered VALID.

I swear the elites of the world must sit around and laugh at how stupid 99% are. The greatest con in the history of the world is the elites convincing the masses that debt and banking were beneficial to them. When in reality the only people it serves are the money creators (those at the top).

- Looking at all the 99%'ers in traffic court that cant afford a lawyer is depressing.
- Seeing all the misc'ers post about how awesome their rewards credit card is makes me want to face palm.
- People bragging about their new BMW they own (lol what) at 5% interest ... just wow.
- 99% of the people on this forum dreaming about being 100K/year CEO when the government takes 40-60% of that (half a years labor) in taxes to PAY OFF THE NATIONALDEBTCREATED BY MONEY PRINTING (BANKING) really just blows the mind.

- Fellow 99%'ers collecting debt from other 99%'ers ... truly is the icing on the cake symbolically.

Always always always answer the phone and at least try to work with them. My firm in particular doesnt like to litigate because our clients are mostly bottom of the barrel scum so we are VERY hardcore.

My best advice is to ask the debt collector who is implying at a lawsuit "ARE YOU GOING TO SUE ME?". Under the FDCPA Debt Collectors are not allowed to threaten to sue if they have no intentions of actually sueing you. Anything other than an outright yes means they dont actually intend to litigate and you can proceed accordingly

Debt creates growth. Tell me if I am able to borrow money at 5% and use that money to make 10% how is that a bad thing? How is using a rewards credit card and paying no interest a bad thing? You seem to have a severe misunderstanding on the industry.

well, if you care about your credit, then that will suffer. If you try to work with creditors, sometimes they can help you out and make some changes that may bump your credit score up a notch or two. I had surgery in 2012 and the bills came from so many different places. Bills came from the hospital, the doctor, the anaestesiologist, the radiology dept for the x rays right after, the Post op dept for whatever they give you (in my case, 5 injections of dilaudid, a lortab and a flexeril so i could get up and walk around), the billing office also had some fees thrown it, the company that owns the hospital sends a bill and the cycle never ends. I had to get a complete statement from my insurance company to track down everyone who was billed (and they dont say Dr Joe Shmoe...its like...NSa (neurosurgical associates) or somethign that requires investigation) and go from there.

then there are the NEW bills that arrive 8 months later. You literally drown in all the open accounts. you can make regular payments on a ton and there are probably some you dont know about until collections steps in

Thats not legal at all. You cant just charge someone out of the blue $300 3 months after they cancelled and then a week later sell that charge to a debt collector cuz you know the customer would dispute it but by then its sold to the collector so the gym already made $$ by selling it.

And the collector would have a voided debt because it wasnt legal in the first place, so the collector would have to go back to the gym and get their money back they spent buying the fraudulent debt.

Thats a felony.

The good thing is i think credit cards with chips cant be defrauded that way cuz its not like they can charge it in the future.

Why don't you take out a loan on your house and invest it into mutual funds then? The return on the mutual fund should beat the interest rate on the loan, what could possibly go wrong?

Do you ever get sold debt that clearly was bogus and what do you do? Personal story - within the same company I upgraded my TV and internet service, they kept me on the old packages plus the new ones for 2 months, I refused to pay for the old package since they removed the equipment with it and had customer service confirm they'd cancelled it that night. They kept agreeing that I didn't have both services but wouldn't correct the charges and threatened to have collection come after me.

Why do you harass the family of people that owe you debt? My uncle is in debt and his creditors call my cell phone looking for him. I've never co-signed any of his debts and I don't have anything to do with his debts, and I don't even know how they got my phone number. Why do I get harassed over debt I don't have anything to do with?

I have been getting called on and off by a debt collection agency for two years for a 22 dollar "past due bill" from a cable company, that I absolutely paid and I have a receipt for (they tried to **** me before so I always save their receipts). Every time they call I ask to dispute the claim, I follow up with the company, and inevitably it still somehow lands back in collections like 3 months later.

How the **** do I get these pahggots off my back? I will pay the damn 22 dollars but I refuse to have a debt collection on my credit report.

I have no sympathy for the kinds of clients that op is probably calling on the daily. But i struggle to see how firms like yours make money.

What's your collection % rate? Since you can't get blood from a stone it must be abysmal, so after overheads etc, what profit is left?

Are you buying the debt at a serious discount ?

Im going to quickly address your complete ignorance.

Junk debt collectors will buy ANY DEBT from the original creditor for cents to the dollar, then turn around and try to collect the full amount from the person. They will even attempt to collect on debt they know is illegitimate. Plenty of case law on this. Many collectors have been sued in the past. They are bottom feeders.

I think you have to threaten to sue them or if your local news does any kind consumer helper thing. Document everything, provide proof they've agreed it's paid and how it keeps coming back.
