Let's not forget that Trump collected "alternative" electoral votes and might be trying to push these into the fray somehow. But this doesn't matter since the individual states never certified any of them, let alone by Dec 14th and according to the Electoral Count Act they're invalid and would require a House majority to overturn or discard any vote.
At this point, one of two things happen: Either Biden gets inaugurated or Pelosi does, and the Senate, SCOTUS and Lame Duck Orangutan are jointly powerless to do anything. Don and Mike leave office on January 20th unless tanks are rolling down the street.
In that case, the Presidency and democracy are something else entirely and Trump not leaving office is a problem which falls a few dozen rungs down the ladder.

That being said, I would hesitate to call Sen. Cruz a constitutional scholar. He's just a Harvard educated lawyer.
