“It’s not like they were removing the offensive behavior; they would just let people keep adding and adding,” he said.

The jury agreed with Mr. Diaz’s assertion that Tesla had created a hostile work environment by failing to address the racism he faced. A vast majority of the award — $130 million — was punitive damages against the company. The rest, $6.9 million, was for past and future noneconomic damages to Mr. Diaz.

“It’s a great thing when one of the richest corporations in America has to have a reckoning of the abhorrent conditions at its factory for Black people,” Mr. Diaz’s lawyer, Lawrence Organ of the California Civil Rights Law Group, said in an interview.

Mr. Diaz said he had reached a breaking point when he witnessed similar racist epithets directed at his son, Demetric, who secured a job — his first — at the company with Mr. Diaz’s help.

“My son watched his father being broken in front of him,” Mr. Diaz said.

In a message to Tesla staff members that was posted on the company’s website, Valerie Capers Workman, a human resources executive, noted that Mr. Diaz was a contractor, not a Tesla employee, and played down the allegations in the lawsuit.

“In addition to Mr. Diaz, three other witnesses (all non-Tesla contract employees) testified at trial that they regularly heard racial slurs (including the N-word) on the Fremont factory floor,” she wrote. “While they all agreed that the use of the N-word was not appropriate in the workplace, they also agreed that most of the time they thought the language was used in a ‘friendly’ manner and usually by African-American colleagues.”

The company, she wrote in the email, was responsive to Mr. Diaz’s complaints, firing two contractors and suspending another. Tesla does not believe the facts justify the verdict, she wrote, but acknowledges that the company was “not perfect” in 2015 and 2016. “We’re still not perfect,” she added. “But we have come a long way.”

I'm not here to cape for Tesla but the bathroom graffiti was supposedly removed by janitorial staff. In the quote above, he says it wasn't. Who is lying? Even so, what are they supposed to do to proactively prevent graffiti? If you've even been to a portajohn on a job site, you know how offensive it gets.

I am curious if the supervisor and coworkers were employed by Citistaff or Tesla.

I'm all for the victim receiving something for damages but $137 million is obviously way too excessive. All this is going to do is set a precedent, and we are probably going to see a massive amount of lawsuits against businesses in the near future. That would suck to be a business owner and lose your business because one of your employees used a racial slur. That cuck judge should be executed.

Seems pretty ridiculous.

- Tesla says the claimants concerns were addressed
- no hard proof re:claimants allegations

Hopefully it gets thrown out on appeal. Otherwise companies will definitely be playing hard defense, meaning that they will either adopt zero tolerance policies or will avoid hiring black employees because of the double jeopardy of potentially disciplining/firing blacks that use n----- among themselves only to face potential lawsuits for racism for disciplining/firing those same people.

If employers feel that they can't win then they may just choose not to play.

After affirmative action passed, employers stopped hiring unskilled, inexperienced, and uneducated blacks and replaced them with the opposite and continued paying the same amount for those positions.

These Marxists and social justice judges need to be very careful they don’t cause another massive shift in hiring practices of businesses.

I realize there could be more to this story, but these are the implications of pretending it’s ok for blacks to use the N word.

This is another point to make; Tesla was creating positions for individuals that would not normally be qualified for anything else. You just need to have soft skills and get a little training. If the building of large, an elevator operator would make sure people aren’t hitting the wrong button and causing employees and customers from being able to efficiently use it.

That being said, its a position easily dissolved in hard times. This is one of those opportunities that are undermined often. It gave him a job when no one else would hire him.
