Trans folks are mentally ill, so it's the same question as "should mentally ill people be denied their 2A rights."

I'm not American, so it's hard to related to what the constitution truly means to you.

What I will say though is, it's a slippery slope. Who else is mentally ill? Should people with schizophrenia be denied access? What about those with depression?

Who fits under the mentally ill umbrella, and who gets to decide?

With 400 million privately owned firearms in the US, and pretty much anyone with a couple hundred bucks able to buy it off a ghetto corner anyway, imo it's better just to make sure the law-abiding people are armed, rather than encroaching on the God given rights of every person if you simply designate them as 'mentally ill'.

You're taking an extreme interpretation of a viewpoint and pretending that it's the entire concept. I literally wrote my thesis on the constitutionality of the patriot act before moving on to study international law. I'm pretty sure I know what I'm talking about a lot better than most yankee internet warriors with a degree in circle jerking on the misc.

I was looking into getting a hunter's license when I get back to the Netherlands and they make you jump through so many hoops. I bet if I do manage to get one I probably would barely even be able to hunt because of animal rights and chit. Which we were as based as the Swiss in this regard.

Idk what you're talking about at all. What exactly are you debating with me?

The 2nd amendment is written clearly and there's supporting documentation from the founding fathers and philosophers from that time period as to why it was put there in the first place.

I wrote a thesis on the tensile strength of turds before and after creatine. I'm equally, if not more qualified.

I don't even clearly understand your point.

You argued that it IS a "living document" because you'd only be able to own guns before the constitution was ratified if it wasn't. That statement walks the fine line of mentally disabled.

The constitutionality of the Patriot Act depends on the reader - your thesis would not have proven any facts. Our current SCOTUS would probably find it unconstitutional even if many of them were put in by the Bush fam.

Right, I just took an extreme example to make fun of the guy for making a dumb statement. Obviously it doesn't mean you wouldn't be able to own arms produced after that date. It being a living document means that you'd still have to look at the definition of the word arms, what falls under it today, what was the original intent of the writers of the constitution.

Does a tank or a rocket launcher fall under the definition arms? Probably not. But does it fit the original intent of the writers suggest the whole reason of the 2A is for the citizens to be on equal footing when it comes to fighting tyranny? Yes it does. It's not as black and white as stating "every citizen should be able to have every weapon without any limitations whatsoever", which I see some people argue often enough.

Regarding my thesis, quite obvious a legal thesis of a bachelor student doesn't prove any facts. My opinion was that many parts of it should have been deemed illegal but in the end it would depend on the SCOTUS. Again, it's about it being a living document in the sense that you need to interpret a 250 years old text and see if the founding fathers would have wanted digital communication to fall under the 4th amendment. It simply makes no sense to claim it's some kind of rigid document. That's not how law works.
