The move was certainly in the training manual. However it could easily be argued it was the knee on his neck that exasperated the symptoms.

I can see manslaughter here but not murder.

Same as if you punch somebody who unknowingly has a blood clot and your punch causes it to dislodge and kill them. You still had a role to play just like Chauvin did when he used ******** Floyd as patio furniture.

But Fowler said that Chauvin’s knee on Floyd was “nowhere close to his airway” and that Floyd’s speaking and groaning showed that his airway was still open. He also testified that Chauvin’s knee was not applied with enough pressure to cause any bruises or scrapes on Floyd’s neck or back.

It’s a bit more gray area than that. Using a textbook tactic to subdue a suspect, even incorrectly isn’t exactly the same as “Iintendedto go over there and choke him to death.”

Jury verdicts are conducted by people with no concept of the law. It also just so happened that people were swayed and afraid because entire cities were burning. It can come down to simple things like just having better representation.

That’s why the appeals process and higher courts exist.

That dumb ass cop undoubtedly committed manslaughter and I wouldn’t doubt that he could get it reduced to just that. Reasonable doubt that he did something other than “lmao I’m gonna go kill this guy” exists.

Someone explain to me why Floyd was yelling "I CAN'T BREATHE" while standing upright and then sitting upright before he threw himself out of the SUV onto the ground. Was Chauvin choking him then, too?

Also, if your airways are restricted to the point of not being able to breathe, how can you make statements over and over?

This is how it should have gone, comparable case. You get into a brawl with a bloatlord. Druing the fight he suddenly passes out and falls down and dies. They find that he died of an aneurism in his heart or brain, it was there before you touched him, and it was a ticking time bomb that would have probably killed him any day now, but because he dies in the fight he was in with you, it's going to be a bad day for you. It will go down as you being partly responsible.

DC messed up. He should have just hog tied him and threw him in the back of the car, he would have most likely died in the car on the way or soon after but instead he just kind of sat on the guy for several minutes doing nothing.

The after fact resuscitation obligation is a real thing - and I feel for policing "in my custody in my care" is a crucial concept to be taken serious - as a citizen, temporally, losing all freedom by being held against your will in custody is an enormous thing - and an enormous responsibility of the state to take serious.

I think there could be an argument that it was a very transitional time in the beginning of Covid, where there's a reasonable fear to give a care to a potential infected person- you choose to resist arrest in the middle of a pandemic, placing officers and compromising positions- too bad so sorry.


That being said I still lean toward guilty of manslaughter due to the after action - A murder conviction here is unjustified- as you well demonstrated.

In other words, when their oxygen demand exceeds their oxygen supply. Yes, Floyd could breathe. But he couldn't breathe adequately to support his oxygen demand for an extended period of time. Optimally, medics would toss a non rebreather and some oxygen on him to support his breathing and have him sitting upright since his airway was intact. Instead, he had his airway hindered and didn't receive optimal positioning or oxygen. Good job by Floyd on doing everything perfectly to lead to him dying by resisting and acting like an absolute buffoon.

Big problem here is LEO hears this bull**** all the time. People say it just to **** with them. Then this pervasive theory percolatesif you can talk you can breatheamong them.No, if you can talk, air is moving through your airway. Oxygenation in the lungs to your bloodstream, removal of CO2 from your bloodstream in your lungs, and oxygenation of tissue from your blood once it leaves your lungs, most importantly your myocardium, are separate processes entirely and are not confirmed by the ability to speak.

This does not fully impair the ability to determine the cause or manner of death since other factors, such as other autopsy findings and circumstances, are available to support the decision making.

Nobody is saying drugs, lifestyle, and pre-existing conditions didn't contribute to his death. But the dude kneeling on his upper back / neck is what actually caused the cascade of events that killed him. Remove that technique, and Floyd lives, from all available evidence.

Oh, I don't think Chauvin murdered him or that Floyd's conditions didn't contribute. That'd be foolish. Chauvin's actions were imprudent and at worst negligent (accurate, imo), nothing more and nothing less. The autopsy just supported what we could already observe. You kneel down on the back of someone who says they can't breathe, laying face down, and they end up having a catastrophic cardiovascular event -- you pulled the trigger on their death.

Chauvin was in a crap position, but he made all the incorrect decisions from a risk aversion standpoint. He basically made all the moves to say "I don't give a **** what happens to this guy." That doesn't fly when you detain someone, especially once they're cuffed.

Gibberish? Only if you don't know what you're reading in context to concentrations of posthumous ******** concentrations. The autopsy findings were conclusive -- Floyd died of homicide and asphyxiation. He wasn't asphyxiated until someone pinned him down with their knee on his neck/upper back. Again, you have no idea what you're actually reading.

You don't understand asphyxiation, either. You understand that if you die of a ******** overdose, it's because it causes bradypnea and apnea (lack of breathing) and therefore you don't have oxygen to supply your heart/brain and you don't remove CO2 from your system and you die of atraumatic asphyxiation, right? He'd have to fall asleep, stop breathing, and then die. It would be precipitated by a decreasing level of consciousness.

Putting your knee on the back of someone like Floyd would be another way to perfectly achieve atraumatic asphyxiation. I'm not sure what the controversy is in your mind other than ignorance. The inability to expand your chest is just as good of a way to asphyxiate someone as causing traumatic damage to their upper airway anatomy by choking them.

As far as my post, because it flew right over your head:

1. Theoretical prediction based on the circumstances (Floyd's health, drugs on board, oxygen deficit, being placed face down, someone kneeling on his neck) = Medical examiner evidence + Relevant studies (such as the posthumous ******** concentration reliability0 + patients presentation + personal experience in similar cases

The only thing that doesn't make sense in the equation is that Floyd waited to die of a ******** overdose until after he was flat on his face and knelt on by someone. That isn't how opioid overdose deaths work.

Again, you have no idea what you're looking at, what you're talking about or what you're reading. You're just too caught up rooting for your "side" and ignoring objective facts, even as they stare you right in the face. You don't even know the basics, like the definitions of words you're citing.

I think there's also this big confusion that because the posthumous levels of ******** in Floyd were high, an autopsy would automatically assume he died of an overdose if he were found at home, dead. In the absence of a patient presentation, story, video footage, etc. - it would be the most likely scenario. The fact that we have video of him awake, alert, oriented, speaking, resisting...and then he gets placed face down and knelt on and then subsequently dies shows very obviously that the ******** was not the causative factor in the death. It may not have contributed at all with the presence of amphetamines in the system as well.

I don't see how this is hard to understand. The conclusion of the autopsy was very clear that Floyd wouldn't die if he wasn't positionally suffocated by an idiot.

You don't understand asphyxiation, either. You understand that if you die of a ******** overdose, it's because it causes bradypnea and apnea (lack of breathing) and therefore you don't have oxygen to supply your heart/brain and you don't remove CO2 from your system and you die of atraumatic asphyxiation, right? He'd have to fall asleep, stop breathing, and then die. It would be precipitated by a decreasing level of consciousness.

Putting your knee on the back of someone like Floyd would be another way to perfectly achieve atraumatic asphyxiation. I'm not sure what the controversy is in your mind other than ignorance. The inability to expand your chest is just as good of a way to asphyxiate someone as causing traumatic damage to their upper airway anatomy by choking them.

As far as my post, because it flew right over your head:

1. Theoretical prediction based on the circumstances (Floyd's health, drugs on board, oxygen deficit, being placed face down, someone kneeling on his neck) = Medical examiner evidence + Relevant studies (such as the posthumous ******** concentration reliability0 + patients presentation + personal experience in similar cases

The only thing that doesn't make sense in the equation is that Floyd waited to die of a ******** overdose until after he was flat on his face and knelt on by someone. That isn't how opioid overdose deaths work.

Again, you have no idea what you're looking at, what you're talking about or what you're reading. You're just too caught up rooting for your "side" and ignoring objective facts, even as they stare you right in the face. You don't even know the basics, like the definitions of words you're citing.
I know you think that editing in several extra paragraphs to your posts each time might somehow distract from the fact that you have once again completely failed to refute what I posted and/or the medical examiner's report, but once again these ad hominems and obfuscation attempts fail spectacularly.

Again, Floyd died because he took lethal amounts of drugs and Chauvin did not cause any life threatening injuries, as backed up by the medical examiner's report. Unless you've done a secret autopsy on Floyd yourself, all your impotent ramblings about how you think overdoses look different and everyone else who doesn't agree with you is a fool are worth as much as the counterfeit bill Floyd tried to pass off. You either haven't read either of the autopsies, or you don't understand what they say. You're taking assessment data from the autopsy and drawing conclusions. The examiners already did the assessment and drew their expert conclusions which do not align with your layman interpretations. You don't have to cause a traumatic injury to cause asphyxiation. What don't you understand from that?

From the medical examiners own words, about his own autopsy, on the cause of death:

Why didn't he cite the ******** and amphetamines as the causes of death? Well, for one, they counteract each other. Two, it wouldn't be the ******** you're arguing that killed him, it'd be the amphetamines, because you can clearly watch the video and see he didn't die of an opioid overdose. Anyone with a cursory understanding of opioids and opioid overdoses knows that. You'd need to be arguing that amphetamines caused a lethal arrhythmia due to the stress of the situation.
Instead, recordings revealed both the prolonged restraint of Mr. Floyd just before his death and also that he appeared agitated rather than lethargic, which could suggest tolerance to higher doses of ********. The drug typically “causes you to become relaxed,” Dr. Wecht said.
The cause of death described by both Dr. Baker and the pathologists who performed the second autopsy amounted to substantially the same thing, some experts said, which was “that external pressure in a prone position to Mr. Floyd caused his death,”

You need to watch the actual video which your link does not have, but suffice to say, yes, he was never on the neck, that’s why the autopsy report does not state it. It also shows Floyd saying I can’t breathe before Chauvin was even over him

There are plenty. We don't even have to get into the trial itself; the denial of his attorney's change of venue motion is reason enough. No sane person would think he could get a fair trial there (and they were right, as it came out afterwards that at least two jurors had already decided to convict beforehand and another one said afterwards she was terrified about what might happen to the jurors if they didn't convict).

He began his "I can't breathe" rant IMMEDIATELY when he got out of the car, BEFORE he was ever restrained at all! He couldn't breathe because he had just ingested a LETHAL dose of ********. ******** is one of the deadliest drugs on the planet and this idiot swallowed a bag of the stuff!

Even the coroner's report said the same......
