Is it or is it not a regulation that is in force in your state? That's all that is going to matter in court, not whether you think it shouldn't be a regulation. The course of action you are looking for is lobbying your legislature to change it, because the court isn't going to invalidate it. Your question was about fighting a ticket, not about the philosophical question of whether your state should take a position on seatbelts to begin with.

Why, specifically, is this regulation not enforceable? Which provision of your state constitution or the U.S. Constitution is violated by the regulation? Unlike the federal government, states have general police power and can essentially do whatever they want so long as it does not run afoul of the state or federal constitutions.
