It happens all the time.If someone gets caught stealing misdemeanors enough times they can up it to a felony. Its not a state thing.Its called Repeat Offender Status sometimes. Theres all kinds of names for it

Only thing i can think of is if he has a history of these crimes. Its a little odd thats a charge and im not familiar with it because i dont have more than 1 of the same charge
