Seriously tho, why are both of you itching to give the other driver every benefit of the doubt (trivializing what they did to just "switching lanes too close", or "refusing to yield") but holding the lady in the video to the highest standard (you don't even know that she could have prevented it; maybe she didn't even know it was happening until she was hit)?
Just seems very odd to me that you are itching to defend the other person who rammed the other driver, but throwing all of the criticism to the lady in the video

Anything else is just speculation
Driving on the freeway is just driving in a straight line. It's the easiest driving possible. There's no excuse for an "accident" unless someone a vehicle malfunction or someone is having a medical emergency like they passed out at the wheel. Somebody messed up, and its clear who it is in the video
Your reasoning for "theyre both at fault" sounds a lot like a kid punching their bully and then disciplining them both
> and not just stupid idiots in a rush to their destination
AKA reckless driving AKA they are at fault

The judge will ask the SUV so what was your reasoning for trying to force yourself into a lane without space and not even use their left hand signal and wait until its clear and safe to merge?
How the hell are they trying to blame this chick she was abiding by the rule of the road nobody expects someone just to jump infront with no space like that wihtout a left turn signal as a warning.
The majority of crashes on the Freeway are idiots who drive wreckless who are impatient and keep changing lands and merging without regard.
Freeway was pretty much designed to be the easiest driving but it has become scary to drive on because morons driving high speed and wreckless.

If you take it to its logical conclusion, how would it ever be possible for someone to be a sole cause of a car accident? If someone drives drunk and drives in the opposite direction of traffic and hits someone head on, we gonna blame the victim cause they should have dodged it?

this, they're both at fault.
> Me:
That may be
I never defended her actions. I would have avoided the accident if I could have. That doesn't mean I think causality of the wreck should be split between them. I think the sole blame lies on the aggressor

She didn't even brake. And if she did, it be highly likely that there'd be no accident. If she braked and the guy hits her, then he would be 100% at fault.

She still has the responsibility to avoid hitting someone if she could help it. Not only was there an opportunity for her to brake or swerve, she did neither.
If the guy switched lanes extremely quick to where she had no time to react, ok fair game. But that wasn't the case here. People are generally very good at seeing other people creep into their lane.
If you argue that there isn't enough time to react, she loses credibility as a driver. Which is how we got into an accident in the first place.

Brb punch a random dude in the face and then we both go to jail for assault cause he could have dodged my punch and avoided the assault, therefore he's responsible too

The woman driving did nothing wrong. Anyone saying she did are either screaming libs or woman haters.
Words to live by...."You're at the shopping mall with your girl but a hot chick walks by. Are you going to look at the hot girl? No. You use your peripheral vision."

Just because you didn't use the word "equal". You also did it in this very post: "Both drivers WERE like the woman in the video. both refusing to yield, leading to an accident".I also never said the lady in the OP couldn't have prevented the wreck. Are you agreeing that the other person is way worse than the lady? If so, we're actually on the same page
2 - There was no need for anyone to change lanes. If all you do is follow your lane, there would no wrecks. Fact
3. No it isn't. Freeway speeds are higher, but you are always driving in the same direction as the person you hit, so the speed differential is less. 80mph rear end someone at 60mph is way less dangerous than two cars hitting head on in an intersection at 45mph each
4 & 5. I never said the lady didn't fulfill her duty to avoid the wreck. She still isn't nearly as bad as the person who hit her, which is my whole point
Also, "Both drivers WERE like the woman in the video. both refusing to yield, leading to an accident" -> No, the other person did not just "refuse to yield", they completely attempted to run the other driver off the road.
I still refer back to philosophy here. Everyone can drive like the lady, and everyone would be safe. If everyone drove like the other person, everyone would be dead. Therefore the other person is in the wrong.

2: sure, there's no need for anyone to ever change lanes. why don't we have single lane freeways? you should only need one to drive, enter, and exit as long as everyone zipper merges like they should, drives at a reasonable pace, predictably, etc. aka everyone is an ideal driver. which is not the world we live in.
3: yes it is lmao. you're legitimately arguing that multi-ton vehicles traveling at twice surface street speeds is not as dangerous? Should I refer you back to the video where the initially at fault driver ended up spinning out and going perpendicular to at least two lanes of traffic? Or are we just going to ignore virtually every variable of physics?
again, you keep saying "attempted to run the other driver off the road" which implies intent of what basically amounts to either attempted vehicular manslaughter or assault with a deadly weapon. Feel free to show me how you gleaned that intent from a video. maybe if you want to argue legalities and fault, you should stick to the laws rather than philosophy
Everyone can drive like the lady, and accidents will skyrocket. Or everyone can drive like neither of these idiots, have a modicum of courtesy, and avoid endangering your own or others lives because of impatience or pride, if only to avoid the exorbitant costs, time and hassle. Again, no one is saying equal fault. but insurance lawyers will absolutely find her partially at fault and thus liable for at least some of her own damages.

nice analogies. even though they are in no way equatable
i'll ask you again. if someone gets stuck in an intersection because they tried to make a left turn in traffic, does that give me free reign to t-bone them when My light turns green because they're breaking the law/its their fault?
fuking grow a couple brain cells dude. You speak in massive hyperbole, and continue to create logical fallacies to try to get your point across only to fail lmao.
and since you guys want to argue about what a court of law would say, why don't you take a look at her following distance and tell me if that's what the DMV dictates.
