lol at open a gate. They destroyed a wrought iron door. Takes some force and dedication to twist it like that.

Nooooope.

The sign at the gate clearly marks it for use by all residents. Taking the sign at face value, it's private property, but it is not their private property. At best, it is an easement for use by the HOA. They are not trespassing victims. The most generous possible interpretation would be to trust that the HOA's rules authorize homeowners to trespass people out of common areas, but that would be a recipe for getting sued that I doubt an HOA's attorney would tolerate.

BUT WAIT, THERE'S MORE. Remember how I said "taking the sign at face value"?

Lots of people put up signs or ask you to sign agreements that aren't enforceable. That the "sign" is just a little thing on a stand at the side of the gate and does not actually mention trespassing raises an obvious question. Why not use the standard language and make it clear that entry is criminal? It turns out, it may be because it isn't a private easement at all and the HOA was just trying to politely discourage people:

This is the National Register of Historic Places form for Portland Place. You'll notice that the checkbox for "Accessible to the Public" is not marked "No", it's marked "Restricted", and the owners are listed as "multiple public and private". The narrative specifies a restriction as follows:

"The gates to both places are open only at one entrance at any given time to prevent the use of these streets by through traffic."

It's long, but I don't see anything about it being closed to the public for tourism or to visitors. This is not a typical gated community with a checkpoint to be buzzed in. It remains to be proven that this was even a private sidewalk, as opposed to a public sidewalk in an old neighborhood that the people who live there wish was private. An attorney and former St. Louis city counselor has said as much to the media, that there's an ongoing issue with "private place" residents pretending they live in entirely-private gated communities:

https://news.stlpublicradio.org/post...legal#stream/0

"Banks, also a former St. Louis city counselor, said residents cannot control which people enter the neighborhood, despite erecting gates and hiring private security. 'That is a myth that private street residents frequently want to put forth,' he said."

Are there any actual facts about the gate? Or just homeowner Word vs โ€œprotestorsโ€ word?

The one thing that is certain is that it was intact when they went through it. That's on video.

Either they bent it later in the protest, or someone else bent it to make it look good. It's definitely irrelevant to the incident itself.

That doesnโ€™t answer the question of how they got it opened. Did they force entry? Is that gate locked at all times?

I donโ€™t care about how bad the damage โ€œlooksโ€ on camera.

if the mob is on camera saying theyre going to kill them and their dog

then they are well within their legal rights. if this was NH, the police would have dropped off a few ammo boxes for the couple

Gotcha. A reporter who has the entire ten-minute video says that he believes the gate was unlocked. The homeowners have never contradicted that. The gate is chained at times but from the video I saw, there's nothing in there indicating that the person holding it open had tools to cut it with, although it certainly could have happened.

Obviously, the sign sitting next to it contemplates that people will come through it.

They aren't. The video follows the group as soon as it comes through the gate and the homeowners go straight to yelling at them and waving guns as they pass the house within seconds. There was not some confrontation leading up to this.

I'm totally prepared to believe somebody threatened them in anger once they pulled weapons or that a protester smashed the gate at some later point, but it just had nothing to do with them drawing on people. Their whole narrative about a mob charging them from a smashed gate being the reason they went to get guns is fantasy. It was as simple as "you can't be on my street", which is debatable at best, and a misdemeanor at worst.
Nah, fukk that. Iโ€™m not doing that.

My favorite part is where they think they can take over blocks, murder shop keepers, do whatever they want and the minute some riot cop exercises violence to stop their excessive violence they then post it and go "OMG look at this!". lol.

It's like punching someone in the face 50x, they then push you back and you cry to the media. They should have all be squashed a lot sooner, now they know they can get away with nearly anything.

If by gate being unlocked you mean destroyed by savages, then yes you're correct. I have no idea why you are defending these "peaceful protestors."

Fixed that for you.

We've done all this before. Miscers think life is a movie and that the law sides with whatever they think feels alpha, including killing people on the thinnest pretexts. Brahs on here half in tears arguing at length that Amber Guyger wouldn't be charged with murder because they can't tell the difference between murder and manslaughter despite the statutes being written in plain English.

There's video. The picture of it bent in half is completely different from what the homeowners saw when they came through it. They explicitly lied about it being smashed to pieces at that point, and, interestingly, are the ones who provided the picture of it bent, knowing they were lying.

As I've said before, the protesters very likely committed misdemeanor criminal trespass against the HOA (not the homeowners) - assuming it's actually a private sidewalk, which isn't clear at all, but I'll roll with it for now. That doesn't mean the two retarded retards waving guns around at people walking past their house on the sidewalk then lying to the media about what happened aren't nutcases who also did something wrong.
Nah, fukk that. Iโ€™m not doing that.

It's not just contradicted by basic knowledge taught in firearms courses and a common sense reading, but Missouri precedent:

https://casetext.com/case/state-v-whipple-31

"Accordingly, considering the entirety of section 563.031 and reading it reasonably and logically, we find that subsection 3 permits the occupier, owner, or lessee to use physical force, including deadly force, in self-defense within a dwelling, residence, or vehicle, or on private property without having a duty to retreat, but only under the circumstances in which physical force, or deadly force, is allowed under subsections 1 and 2. Thus, we cannot find that subsection 3 gives the occupier, owner, or lessee authority to stand his ground and use deadly force without having a reasonable belief that such force is necessary to defend himself or a third person from what he reasonably believes to be the use or imminent use of unlawful force.

Although the interaction between subsection 3 and other provisions of section 563.031 is a matter of first-impression, our interpretation finds support from other Missouri Court decisions discussing duty to retreat under prior versions of section 563.031...."

You can't go around executing trespassers in MO. Now, does that mean they're going to be charged with assault? No. It's just a bad take on Missouri's implementation of Castle Doctrine.
Nah, fukk that. Iโ€™m not doing that.

How is it "definitely irrelevant"?

The gun toters were defending their property because they suspected the 'peaceful' protesters may not be so peaceful. If they were able to easily stroll through the gate on entry, why is it damaged? Maybe because the 'peaceful' protesters have a propensity to not remain peaceful.

Gunbrah was fully aware the possibilities that existed to escalate, and he didn't want that to happen on his property. And it didn't.

Ah yes, it's a classic scenario. You see someone trespassing on property that is not actuallyyourproperty, so your wife gets so scared that she runs over to them to stick a pistol in their face because even though this is just a non-violent misdemeanor, you both know, deep down, that they're probably capable of committing vandalism at some later time. Totally cool and normal reasoning, and not at all psychotic.

As I've said before, there's nothing wrong with defensive display. More states have specifically encoded it into their statutes, and they should. That sloot went up to people and aimed at people's heads with her finger on the trigger. She's a nut.
Nah, fukk that. Iโ€™m not doing that.

The entire government at all levels, local, state, fed, has become a fuking joke. The AG is supposed to be apolitical not a marxist stooge. She called them "peaceful protesters", how about you do your fuking job and prosecute the "peaceful protestors" who "peacefully" broke through the fuking gate and trespassed on private property and maybe the city should think about using the police, while theyre still funded, to stop angry mobs from rampaging on private property.

Theres a quote from a lawyer above that disagrees with you and says that states castle doctrine applies to the private road that they partially own via an association.

If I was a middle class random brah I would not want to have to get into that legal battle... but tony montana jr looks like he can afford it.

this is all intentional. What you're seeing isn't incompetence, it's the plan working out as it's been designed.
