He's a douche and not even a good MMA fighter. BRB negative win loss record. Lol prolly insecure about it which is why he has to beat up on people that are literally zero threat to him.

He was looking for trouble cause he's trash and wants an excuse to beat up on an officecel. Guy didn't even see him behind him, so he decides to literally push him aside which he damn well knows is going to start a confrontation. A confrontation that he knows he has the upper hand by a long shot. I'd like to see what would happen if that was a fellow MMA fighter if he would just push him to the side. Guarantee it would go differently.

Then on top of that bragging on social media about it like it's something to brag about. Buddy you're just a POS.

From the video, this is a clear assault case lol. He walked from behind the guy, shoved him out of the way, and then was confronted for pushing the guy. Then proceeds to punch the dude in the face and walks away like nothing happened. Most if not all fighters are aware that the statement can be made in court that their hands can be considered as lethal weapons. They aren't registered, but the court can make the argument for the jury to hear. By pushing the guy first on video, he is the instigator in this argument, and the defense can claim the drunk dude was acting in self defense.

Had he tapped the dude on the shoulder to get through I'm sure there wouldn't have been a problem lol. Had the guy then got up in his face and then put his hands on him, then if he clocked the guy it would be fine.

Lol he was looking for any excuse to knock that guy out. Probably told his buddy to roll the camera beforehand.

Schilling actually has a very impressive Kickboxing/Muay Thai career. Even though his MMA record sucks the guy is an elite fighter.

Exactly, that's what most people would do. But he's a hard ass and wanted an excuse to beat up on someone.

In the olden days, he would have killed that man and fukked his bitch.

Now he just catches a case and the victimcel has the last laugh.

In the olden days Joe would have been already been dead from a superior fighter, prolly would've been decapitated with a claymore or KO'd himself since he has a glass jaw. The officecel would have been long dead as well.

There is assault. A reasonable person would be scared in the moment prior to the punch.

An MMA fighter squaring up on you doesn't make you feel fear of physical danger? Lmao I was like lmao.

First of all, don't play that off. You didn't know the definition - nobody that does puts battery before assault. "Battery and assault" - no. Please.

Second, the victim was totally not afraid, he was drunk and said some sort of sht to Joe. Joe, apparently an idiot, thought that unafraid bar sht talk excused his actions. Effectively he would have to claim the victim assaulted (but not battered) him.

Did you watch the video? Go to :14-:16 - he doesn't look scared to me. Apparently he should have been, but apparently most normal people don't think that a bump from behind and sht talking is going to turn into potential homicide.

Crazy to think that theres probably at least one dude like him in every bar and club. Even if you're a pro MMA fighter you would not see that coming, so the typical pencil neck miscer has no chance. Could end up with a detached retina, broken neck/back, brain damage, broken jaw, broken orbital, lost teeth etc. What a way to end a night out with some friends.

Of all the things you can aspire to as a man growing up, all the ways you can focus your interests and earn a living to provide for yourself and your family, he chose beating people up for money.

Imagine my surprise to see this video and come to find he is a douche. LOL, yeah, right....shocker.

This is getting very legally technical, but no.

The shove from behind certainly amps things up and sets a stage for what happens next, but in of itself I don't think anyone could claim it puts a reasonable person in fear of physical harm and at that point Joe was continuing to walk past him like he thought it made him badass.

Whatever the victim said next in response to the shove would be the thing Joe would have to claim forced him to respond to with potentially lethal force. He's obviously never going to be able to make that claim work - but the initial shove wouldn't make it impossible.

impossible is hyperbole but literally of course its not impossible for other situations.

For what you describe to be the case, the officecel would need to present a credible threat which does not mean that verbal threats automatically qualify. He had no weapon, and Joe was clearly aware of his own status as a trained fighter. There's no reasonable way Joe could have felt threatened so due to that, for this specific situation, I'd still say its impossible.

will 12 random people follow this logic? nah.

We are agreeing about how it plays out, I'd say it's impossible for Joe to claim he was so afraid all he could do was bareknuckle KO the guy. My only point was that Joe's shove that started it isn't the thing that makes that impossible.

I'm not doing the world's best job at explaining this, but I think we're on the same page.
