"Mistake of age" is only a legal defense for statutory rape in a few states. Most states say that it doesn't matter whether you knew their age or not, the act itself is a crime either way.

It does look like the California supreme court recognizes "mistake of age" as a defense so if this happened in California he could potentially use it to escape criminal charges.
