I'm not going to argue for or against the girl spending life in prison because quite frankly I don't have to, and unless I'm a judge or jury in that spot I'm not going to entertain the thought. That said, my arguing point is that an elementary aged kid most definitely knows that this is going to harm a baby, unless of course this 10 year old is mentally handicapped in some form.
And my point was that I don’t think a child necessarily knows where the line between harm and murder is

Obviously the girl knew she’d hurt the baby. The girl is fukd up. Did something unforgivable. But I just dont read the article and think murder.

Exactly. What positive outcome will come of this 10 y/o's life?

Committed a heinous crime and is scarred as f*ck

I know everyone is disagreeing with you ITT, but it seems as if you're talking about whether the 10yo girl understands the legal definition of murder.

At 10 years of age, you know not to stomp on babies' heads, and you know that babies are fragile.

Sure, a 10yo is very unlikely to understand the ramifications to follow, but not understanding how her life will be ruined and that it's classified as murder is different to not knowing that when you stomp on a baby's head, it will die

No I just don’t think she meant to, or thought she would kill the baby

I think she was trying to make the baby stop crying. I think she was thinking this will make it be quiet. Not, if I do this I’m going to kill this baby

I believe that since she is a juvenile, they can only hold her in jail till she's 21, unless they decide to try her as an adult; This seems highly unlikely. However, if she gets committed to a mental institution, she could be there for quite a long time.

One way or another she needs to be separated from society because she is and unfortunately always will be a danger to it.

10 yr olds are old enough to know right from wrong. Usually that's instilled around 6 yrs of age

Jesus what a horrible story.

I know she's only 10 but they absolutely know right from wrong and that's pure evil. I don't think any one of us could wrap our minds around it even if we tried.

Bro, a 10 year old know what it means to physically fight someone and hurt them

fuking stomping on a baby's skull repeatedly while blood is coming out, isn't something that a normal 10 year old who can be a productive member of society does

In relation to what legal ramifications they have and how long they should be in prision, or what solutions etc the answer is open ended as fuk

But one thing for sure is that this child is fuked up beyond any immediate repair

Kids make mistakes, but we're all just going to sit here and pretend that a 5th grade doesn't know that stomping on a baby's head is completely phucked up?

We aren't talking about cutting in line or stealing a jolly rancher. She stomped on a baby's head.

Do I think a 10 year-old should serve life or face the death penalty? No, she's a child. She'll grow up to be a violent twat in all likelihood, but of course she shouldn't be tried as an adult. Whoever raised her needs to be thrown in jail though.

But does a 10 year-old understand these things? Of course. She's 10, not 2. Children aren't retards (except the ones who literally are).

Yes.

That’s why she did it. She didn’t stomp the babies head because he thought I felt good.

Nothing will happen to the girl. They will just position her as being a victim of sexual assault, poor parenting and daddy issues.

This ain't the first time kids have committed murders. There was a big case many years ago where several boys killed a toddler. I believe they were put away in Juvi and then continued with more time in jail.

That's very kindergarten bro.

In kindergarten, if you take something from a kid... they will throw a rock at your face/ head at recess. Pushing other kids off playground equipment is a daily occurrence. Teachers have a very sh it job here. BRB being blamed by parents for everything there dirt kids do to others. Kids are very wild and show human nature in all its selfish glory. Parents aren't doing a good job anymore... raising their kids with an iPad.

https://en.wikipedia.org/wiki/Murder_of_James_Bulger
Closed-circuit television (CCTV), surveillance from the New Strand Shopping Centre in Bootle taken on Friday 12 February 1993 showed Thompson and Venables casually observing children, apparently selecting a target.[7] The boys were playing truant from school, which they did regularly.[8] Throughout the day, Thompson and Venables were seen stealing various items including sweets, a troll doll, some batteries and a can of blue paint,[9] some of which were later found at the murder scene. One of the boys later revealed that they were planning to find a child to abduct, lead him to the busy road alongside the shopping centre, and push him into the path of oncoming traffic.[10]

That same afternoon, Bulger, from nearby Kirkby, went with his mother, Denise, to the New Strand Shopping Centre. Whilst inside the A. R. Tym's butcher's shop on the lower floor of the centre at around 15:40, Denise, who had been temporarily distracted, realised that her son had disappeared.[3][11] Thompson and Venables approached him and took him by the hand, leading him out of the shopping centre.[12][13] The moment was caught on CCTV at 15:42.[14][15] Thompson and Venables took Bulger on a meandering 2.5-mile (4 km) walk across Liverpool to the Leeds and Liverpool Canal where he was dropped on his head and suffered injuries to his face. The boys joked about pushing Bulger into the canal.[8][16] During the walk across Liverpool, the boys were seen by 38 people.[17]

Bulger had a bump on his forehead and was crying, but most bystanders did nothing to intervene.[18][19] Two people challenged Thompson and Venables, but they claimed Bulger was their younger brother or that he was lost and they were taking him to the local police station.[20] At one point, the boys took Bulger into a pet shop, from which they were ejected.[16] Eventually the boys arrived in the village of Walton, and with Walton Lane police station across the road facing them, they hesitated and led Bulger up a steep bank to a railway line near the disused Walton & Anfield railway station, close to Anfield Cemetery, where they began torturing him.[8]

James Bulger being abducted by Thompson (above Bulger) and Venables (holding Bulger's hand) in an image recorded on shopping centre CCTV
One of the boys threw blue Humbrol modelling paint, which they had stolen earlier, into Bulger's left eye.[21] They kicked him, stamped on him and threw bricks and stones at him. Batteries were placed in Bulger's mouth and,[22] according to police, some batteries may have been inserted into his anus, although none were found.[3] Finally, the boys dropped a 22-pound (10.0 kg) iron bar, described in court as a railway fishplate, on Bulger.[23][24][25] He sustained 10 skull fractures as a result of the bar striking his head. Dr Alan Williams, the case's pathologist, stated that Bulger suffered so many injuries —42 in total— that none could be isolated as the fatal blow.[26] Thompson and Venables laid Bulger across the railway tracks and weighted his head down with rubble, in the hope that a train would hit him and make his death appear to be an accident. After they left the scene, his body was cut in half by a train.[27] Bulger's severed body was discovered two days later on 14 February.[8] A forensic pathologist testified that he had died before he was struck by the train.[27]

Police suspected that there was a sexual element to the crime, since Bulger's shoes, socks, trousers and underpants had been removed. The pathologist's report, which was read out in court, found that Bulger's foreskin had been forcibly retracted.[23][28] When Thompson and Venables were questioned about this aspect of the attack by detectives and a child psychiatrist, Dr Eileen Vizard, Thompson and Venables were reluctant to give details; they also denied inserting some of the batteries into Bulger's anus.[3][17][29] At his eventual parole, Venables's psychiatrist, Dr Susan Bailey, reported that "visiting and revisiting the issue with Jon as a child, and now as an adolescent, he gives no account of any sexual element to the offence."[3]

The police quickly found low-resolution video images of Bulger's abduction from the New Strand Shopping Centre by two unidentified boys.[8] The railway embankment upon which his body had been discovered was adorned with hundreds of bunches of flowers.[30] The family of one boy, who was detained for questioning but subsequently released, had to flee the city due to threats by vigilantes. The breakthrough came when a woman, on seeing slightly enhanced images of the two boys on national television, recognised Venables, who she knew had played truant with Thompson that day. She contacted police and the boys were arrested.[31]
They were released in 2001, and given fake names. Venables was arrested multiple times again for Child Pornography.

Some people are just monsters that can't be rehabilitated.

We'll do society a favour in the long run by putting her down.

There was a very early teenage girl who lured a 9 year old boy, strangled him and cut his throat. So yeah, I have no problems with anyone receiving the death penalty or life in prison if they prove to display such evil crimes. At worst they should never be let outside near normal humans. Just because you're a minor it doesn't mean you are innocent and cannot understand your actions. There's zero room for sympathy when it comes to crimes of this extreme nature. I wouldn't want to even imagine what the parents of the victims feel like.

There are some good documentaries about young serial killers, it's wired and psychopaths and evil disorders have to be separated completely from society. Don't let someones appearance fool you, evil can start at a very early age regardless of their upbringing. There's single age digit killers who show no remorse and even smirk when they are retold of what they have done. Personalities and tendencies can be very innate and easily spotted at an extremely young age as well, I've seen this myself in real life and watched it.

I understand if you mean like a normal fight and they accidentally did something like body slam a kid on their head. Each case is obviously on it's own merit, but something like stomping someones head over and over, or doing it to a baby well there's no room for interpretation and no point taking a risk. What I despise is when some 16 year old shoots up a place and murders some workers but they aren't tried as an adult and only get something like 15 years because people have a soft spot purely because of their age.

Wow... not trolling for once?

This is true. Even kids around 3-4 understand life. It's why they like insects, birds, dogs and try to take care of them and don't want them getting hurt. Heck, they even do this for teddy bears too.

A 10 year old understands what is right or wrong. This 10 year old is just a bad seed. It's not like bad seeds (aka truly evil humans) were never born.

I totally agree with this. People are born with it. I know a few narcissists. The only thing holding them back is they are chickens. If there were no laws, I'm sure they would do very bad things.

After falling in disgrace to a manmore, a ravaged manlet would not hesitate to come from behind and land a sucker punch/ swing with a rock to the back of a manmore's head. They are ruthless and you need to spend some more time in the gutter to even begin trying to comprehend what goes on in their minds."

ITT psychopathy and sociopathy are used interchangeably.

One other thing to think about. Yes, typically a 10 year old understands right from wrong and has a sense of morality. However, abuse or a violent environment both have been shown to delay development, meaning the 10 year old in a healthy family environment develops morality on "the timeline", while the 10 year old in phucked up circumstances might not.

As to what should happen to this child....I honestly don't know. Not the death penalty. But prison or mental institution, I'm not sure either will help her at this point.
