Hey man sorry to hear that but I think you will be ok. Just do not drink as MUCH as you did. Don't get drunk. Drinking and Driving has nothing to do with driving and everything to do with drinking until you are too drunk to think and act. I don't like when people say it affects your "judgement". That is bull****. That is a huge understatement. It affects your choices. It is a powerful and dangerous.

A person who drinks little or not so much is actually less likely to drive after drinking because they can still understand that it could lead to huge problems. However,

a person who has drank a ton of alcohol and is extremely smashed is more likely to decide to drive.

Some people don't realizde this.

I can beat that. In '12 I did 258 days for a crime I never committed. Long, boring story. But at least in county jail you get TV, phone calls, commissary. It's like a resort compared to the 97 days I spent in a state prison intake house where you get none of those. They give you one envelop if you want to write a letter and you can have books mailed in to you but that takes weeks. Three weeks in, you can buy more envelopes and paper. The rest of the time you sit and wait to be transferred. It's a level of boredom that cannot be fathomed without firsthand experience. It was like sensory deprivation because there were no sounds besides inmates in other cells chatting. No sights besides the same barren walls. There was a window but it was covered so you couldn't see out toward the parking lot. No smells except during meals when it smelled like soy meat and starches. If I had committed a crime in the first place I would never want to again.

I don't drink but in the past I worked in the DUI "industry" (people that profit from people getting DUIs)
My suggestion are
Only poor people get convicted of DUIs ... Spend every dollar you have on a good lawyer and he will get you off
Spending big money today (court, defense) will save you a giant amount of money in the future
Dont do it again.

Aggravated battery of a peace officer. I was at college, cops called for noise complaint. I played "street lawyer" according to cop. He decides to arrest me for disorderly conduct. I piss him off more by giving him attitude. Three days later I find out he changed my charge from disorderly conduct to aggravated battery of a peace officer and claims I headbutted him during the arrest. No cameras, no recordings. This was a little town downstate in the middle of nowhere. Everybody knew each other. I wouldn't be surprised if the judge, the DA, the PD, and the cops all got together on weekends to play golf together. It was ****ed up that for being at a party that got a little too loud I was facing 7 years in prison. So I took the plea. Three years later I violated because I couldn't find a way to get the probation meetings anymore so I went awol so they revoked it, resentenced me, and I got 4 years at 50% for good behavior, or 120 in the incarceration impact program, aka boot camp. Was a five month wait to get into the program though that I spent in county and the the intake and processing house I mentioned earlier. So I got screamed at beaten around by ex-marine and ex-army corrections officers and got out and did two years parole and finally got that **** put behind me as of October 2015. For a party that was too loud in January 2009.

You would seriously be ****ing surprised. It's all about money and politics though. Prisons make a lot of certain people a lot of money. Having high incarceration rates also make politicians look good because they think it shows that they're tough on crime. The presumption of innocence is a myth and the whole system is setup to put away as many people as possible. State's attorneys keep their jobs because of their incarceration rates, not for keeping criminals off the streets. Poor people cant afford attorneys and get stuck with public defenders. PDs work for the state and in tandem with the DA in order to get a plea a bargain, not to defend the innocent. And don't get me started on cops.

I was working out in the afternoon with a buddy using the pull-up bars by an elementary school. As soon as it starts to hit dusk we head to my car that is around front. As soon as i get to my car i notice a police officer in the empty parking lot. We get in and start driving off and he instantly puts on his lights. I pull over, do the paper work BS, and he asks what we were doing. I said, "Working out sir". We were both sweating like crazy so it was obvious we were working out or having gay buttsex.

He acts all cool during the whole thing like he's my best friend then all of a sudden out of the blue, "Do you smell that?" I look over at my buddy in the passenger seat and roll my eyes. I respond to the cop, "No sir." He shines his light at me again, blabbers a bit, then says we can go.

I have zero traffic citations, nothing on my record, I don't drink, don't smoke, don't do drugs ... and yet literally every time i have to speak to a cop around here they always try and pull some shady BS on me. Was worse when i had my motorcycle. They almost always seem to turn nothing into something. 3 weeks before that i got a ticket at 7am on a weekend on an empty road as i was driving to me nieces funeral for doing like 5-7 over. I told the officer where i was going, was dressed like i was going to a funeral, had chit in the passenger seat for it, and all i get is... "I'm just doing my job."

... but they're never pulling people over for weaving in and out of traffic. Not following right-of-way. Sitting in the fast lane. Cutting people off. Heck... yesterday i saw some dude peel around the car in front of him ... cut it off... then slam on the brakes. I was completely shocked there wasn't a wreck considering how busy the road was. I see stuff like that every day and not a cop in the world. But working out behind and empty school or doing 5 over on an empty road .... that some law breaking chit.

I remember like 7 years ago getting a $200 ticket for having a 6oz Styrofoam cup inside a cooler on a river here in Texas. As i was getting the ticket (which the cop didn't inform me of until it was too late ... i had no idea i was getting a ticket) a bachelorette party floats by with a raunchy blow up doll, penis sippy cups, blasting loud music, and drunk as a chit. I literally looked at the cop in disbelief...

I got a DUI on a Tuesday night after not drinking 2 hours before my last drink. I blew a .08. Pulled over in a residential area for failure to use my turn signal. I can't say I've never drove plastered before - I was just lucky. I don't risk it anymore.

Probably cost me 8-10 grand from missed work, court/lawyer fees, classes/courses and insurance. I basically made the guys who work for me drive me around so i didn't bother with the restricted license or interlock. Life goes on.

I can't judge because I was once a retarded 22 year old.. But New Years Eve and all the options they have on this day? Come on brah.

Best of luck and just take it day by day. It's not the end of the world and you can usually get the first one expunged after a few years if your career trajectory will be affected by this. (It's expensive and you'll have to hire a lawyer, not all states offer it on DUIs)

Don't try visiting Canada, you'll have a bad time.

I'm not going to judge you OP. You sound like you are genuinely sorry about it. Don't let it happen again though. Notbadnotbrad had the same thing happen to him, but he decided to change his life for the better and took steps towards doing that.

I have zero traffic citations, nothing on my record, I don't drink, don't smoke, don't do drugs ... and yet literally every time i have to speak to a cop around here they always try and pull some shady BS on me. Was worse when i had my motorcycle. They almost always seem to turn nothing into something. 3 weeks before that i got a ticket at 7am on a weekend on an empty road as i was driving to me nieces funeral for doing like 5-7 over. I told the officer where i was going, was dressed like i was going to a funeral, had chit in the passenger seat for it, and all i get is... "I'm just doing my job."
I think my distrust for cops all started way back when I was younger having an experience that follows in line with yours and is probably why when I was arrested I felt the need to "play street lawyer," as the cop put it (because any attempt to enforce your civil rights is viewed by officers as provocation). I was 19 and was out for a walk one night. Normally I'd be working because I worked the night shift as a dishwasher. But I had the night off and nothing to do so in went out for a walk. A cop stopped me and told me to go home and that he would arrest for me loitering. And it was infuriating because all I was doing was literally going for a walk around my neighborhood and any attempt to explain that or ask him any questions just seemed to rile him up. So I finally gave up and went home. And thus I was introduced to the police state.

Three years later I violated because I couldn't find a way to get the probation meetings anymore so I went awol so they revoked it, resentenced me, and I got 4 years at 50% for good behavior, or 120 in the incarceration impact program, aka boot camp. Was a five month wait to get into the program though that I spent in county and the the intake and processing house I mentioned earlier. So I got screamed at beaten around by ex-marine and ex-army corrections officers and got out and did two months parole and finally got that **** put behind me as of October 2015. For a party that was too loud in January 2009.
Damn.

LEO's don't like that "street lawyer" business, it's gotta be 10X worse with 3 cell phones filming you doing your job these days.

I played HS sports with a guy who went on to be a cop, the guy never liked me. When I was in college and he was enforcing the law he tried to drag my ex GF over a waist high fence by pulling her hair until she complied. I told him that wasn't OK, so the attention immediately turned to me. I backed off and the situation slowly de-escalated. About 6 years later he was doing a training drill and was shot and crippled by a fellow officer, he's still in a wheelchair today. He tried to friend me on FB which I find really odd.
