Is the robber a POS? Absolutely. Did he put this on himself? Absolutely. Did he deserve to be executed? Absolutely not.

That's all I'm saying.

They’re less likely to go commit the crime. People take the path of least resistance, and again, most criminals aren’t “hard” or skilled like they think they are. They rely on easy (unarmed) targets and compliance. Tell them that they’re going to die at 23 if they keep the **** up and they’ll probably decide to get a minimum wage job or at least just steal from vending machines.

You’d have to be a complete idiot to pull that crap in Texas, and I’m sure that was one of that loser’s last thoughts before he faded off into eternal darkness. Serves him right.

Just seen an update on this on Inside Edition. Apparently the perp had a BB gun . Someone was asking if the shooter would be in trouble because of that fact , and they said no .
There’s a law but can’t remember what they called it.

They never mentioned anything about that last shot either , as I thought they may come into play

Found this in a story about the robber:
Records show that in 2015, Washington was convicted on a lesser charge of aggravated robbery with a deadly weapon and sentenced to 15 years in prison in connection to the shooting death of 62-year-old Hamid Waraich, a cell phone store owner. Houston police also charged two other men.

According to records, Washington was released on parole in 2021 and charged with assaulting his girlfriend in December 2022.

Waraich had a fiancée and three sons who reacted strongly when contacted by ABC13.

"If the guy who sopped Eric was around 10 years ago, maybe I'd still have my dad," Aman Waraich, the son of the store clerk that was killed, said.

"Eric was an evil criminal that took joy in harassing and robbing innocent families. The individual at the taqueria is a true hero!" Sean Waraich, the victim's other son, added. "He did the right thing in stopping the robber and in protecting the community from a dangerous perpetrator."

I won't even bother debating whether you should assume someone pointing a gun will use it. It doesn't matter.

Texas allows deadly force in defense of property. As they should. An honest citizens wallet is worth more than a scumbag's life.

Citizen had a right to shoot the guy the moment it turned into a robbery. He did what Texas law considered the right thing.

Pro tip: if you've ever done training with a use of force simulator, you'd realize how impossible "idk, I'll wait until I'm sure he's gonna hurt someone" really is. Most people take your attitude and get shot, way past the point where they could have justifiably engaged.

Believe it or not, him having a BB gun as an excuse wouldn't even fly in California.

There are jury instructions on how to properly navigate a killing as to whether or not it was justified.

The document is called CalCrim505.

One of the things they tell the jury is the actual threat doesn't have to be present, only the mere belief of it.

Having a BB gun, which can't actually hurt anyone, is irrelevant. Him using the BB gun that looked like a real gun would instill fear in any reasonable person, and therefore the fact that the gun is fake is completely irrelevant.
When deciding whether the defendant’s beliefs were reasonable, consider all the circumstances as they were known to and appeared to the
defendant and consider what a reasonable person in a similar situation with similar knowledge would have believed.If the defendant’s beliefs were reasonable, the danger does not need to have actually existed.
