Penny, 24, pulled Neely to the ground from behind and held him in a chokehold as two other men helped restrain the agitated man. Neely initially flailed his arms, but within minutes, can be seen going limp in the disturbing footage.

The Fire Department said it received a call for help at 2:39 p.m. and arrived on the scene seven minutes later.

The city's medical examiner said Wednesday that Neely died from compression of the neck.

Now, Daniel Penny is expected to turn himself in to police on Friday morning to face a manslaughter charge.

"We can confirm that Daniel Penny will be arrested on a charge of Manslaughter in the Second Degree," a spokesperson for the Manhattan District Attorney's Office said. "We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow."

Yeah that isn't written a certain way to invoke pathos. In a sane world a man who was arrested over 40 times would have been in prison. The video that everyone has been talking about only shows what, a fraction of the altercation? I could be mistaken, but isn't there a longer video showing that he did indeed let go and put the guy into a recovery position? Also, why isn't the other guy who helped restrain him getting charged with anything? One could argue he is an accessory by holding his arms.
