One person approached a larger person with intent to have a physical altercation.

Imagine being the smaller person. When deciding to fight the larger person, did you consider all the potential outcomes? Which outcome were you hoping for? That the larger person would not attempt any sort of defense? That the defense would be disproportionately small, thereby allowing you to dominate the other person? That the defense would be proportionate, leaving the altercation to be governed by stamina and/or interference by other people? That the defense would be disproportionately great, creating the potential to appeal to a lack of fairness? These are just a couple options, but in truth the outcome would sit on a "spectrum of favor", for lack of a better term.

Then there is the difference between the outcome hoped for, and the outcome expected. If you instigate the altercation, and you are the smaller person, obviously you hope for a favorable outcome but should you expect it?

If the outcome is unfavorable, can you fashion the outcome so that it benefits you somehow? Is there some socially accepted norm that you can appeal to in the event that the outcome is neutral or poor for you? Better yet, can you instigate the altercation knowing you can appeal to this socially accepted norm later to change the outcome? Are you more likely to instigate such because of this well known potential?

Heh, while I still don't agree with fighting anyone over concrete like that, have to admit he handled it like a boss. Told them it was his property and he didn't want them there, and to leave. Was attacked and responded. While, again, I still don't agree with his decision - I also wouldn't support any kind of legal action against him even if she became seriously injured from that.

How would you know the larger person's intention was necessarily both to

1) bring the smaller person to the ground AND
2) bring the smaller person's head into contact with concrete?

What you can tell is that the smaller person intended to have a physical altercation with a larger person in an environment in which concrete was the mat.

Because what i saw in the video was a female incapable of doing anything..

She was trying to push him but it looked like it was going nowhere.

Longer version shows her kicking him the nuts ( i still havent watched)

But i still highly doubt in court of law.. kick in nuts = potentially killing them. That seems like an exteeme escalation on his part

And besides we dont know where he lives and there are other issues that could prob be brought against him. People have been charged with manslaughter in self defense

We don't really know this, do we? What we do know is that the outcome ended up unfavorable for the smaller person. It is possible that the outcome could have ended up anywhere else on the spectrum. But is it probable? Shouldn't the smaller person have predicted the altercation would be lost due to poor odds?

I'm not arguing the legal ramifications.

You become the aggressor in an effort to end the altercation intended by the original aggressor. It's easier to become the aggressor when you are larger (or stronger, and/or more skilled) than your opponent. When you are smaller (or weaker and/or less skilled) than your opponent, you run the risk of your opponent accessing a greater potential for violence. This should be a vital consideration, and happens to be a non-issue when it comes to same-sex altercations - an acceptable consideration even with largely mismatched opponents. But for some reason, opposite-sex altercations are governed by different rules - not due to the magnitude of the mismatch (if any), but purely by genitalia. For some reason, the smaller person needs to consider the risk only when they have the same type of genitals as their opponent.

That is "defense"

Not escalating the violence.

Given the definitions i gave you there is still an assessment of threat.. and where does 100lb teenage girl rank on that list?

I dont think either should get away scot-free

Just that the dude should pay ramifications (half) for inflicting damage when there could have been none, and the girl should learn not to start chit

Hell, punching her the in face would be equal force imo. But not risking pounding her head on concrete

Luckily his arm was in between the concrete and her head.

She has a history of seizures, which she stated herself. If you know anything about seizures, which I do, considering my girlfriends mom gets them, and pretty bad ones at that, and that seizures can occur out of the blue or at times of high stress.

Of course they can happen from head trauma but her head never hit the ground, and this seizure could totally be a result from that but it also could've been a result from mental stress that she caused herself, but in the end, it's nobodys fault but her own.

Even in this egregious example.. do you not see how no eye-site does not equal killing someone?

Maybe if they tried poking you and you poked back it busted their eye and then they fell and died (thats reasonable force) but to go from poking someone in the eye to shooting them in head.. thats an escalation of violence

But even still.. that was not the case with this case presented..

Seizures thing is interesting. Still think he escalated and attempted to use deadly force

Lets be honest.. that teenage girl isnt trying kill him
