similar situation happened last year near me. 17 year old sloot with provisional license rammed into two bikers and killed them. its just a chitty situation all around tbh

theres also something i saw last year about two guys that were high in the middle of the freeway and got hit by a car at 1a.m. in the morning. Guy was going 90+ but these fukin idiots were on the freeway trying to cross in pitch black

Sentencing range for the most egregious death by dangerous driving is 7-14 years. Concurrent sentences are very common, 4 bodies = 1 for sentencing purposes.
The guilty plea is what most likely bought it down from 14 to 10.
It's disgusting that manslaughter by vehicle sentencing guidelines don't match manslaughter.

With your logic though, it kinda goes like this -

Racing driver guy races against other racers (legal racing)

During the race his car touches another racers car by accident, spins them out, and kills them.

He was fully conscious that by racing this could happen

He deserves to go to prison

If you undercook food by a mistake, let's say your thermometer was broken and gave a misreading, you serve the food to someone, they get food poisoning. It's not like you intended to give that person food poisioning, infact you went out of your way, even used a food thermometer, had no reason to suspect it was broke, food looked right, etc...

Another example -

Mother is looking after her child in the playground, another parent talks to her, she briefly isn't watching what her child is doing, something happens to child. The mother consciously made a decision to speak to the other parent, she only looked away from her child for 5 seconds. Therefore she intended on her child getting hurt? Obviously not.

He INTENDED to text and drive.

We often do things without thinking about potential consequences.

You could be driving a long and reach down for your drink, feel that it's not in the place you left it, then glance down, find that your drink was in cup holder 1 instead of cup holder 2, look back up and crash into someone.

You could be driving a long, hear your phone buzz, glance down at it and reply, then think "Oh yeah, I shouldn't be doing this, gonna stop right now", glance back up, and crash into someone.

With hindsight we all agree that we should always have all of our attention on the road. But a lot of the time in any situation we get momentarily distracted, it's not that we decide "Oh wait one sec, gonna decide to get distracted here, I know I shouldn't decide to get distracted, but i'm going to decide to get distracted anyway, 1 sec".

If something causes you to think "I shouldn't be doing this" well then guess what....

I know a guy from high school who killed 2 people drinking and driving. Super highly intoxicated he didn't even remember the accident or killing 2 people. Plus he just got a DUI 2 weeks prior to the accident, so guess he gave no ****s about the law.

He was sentenced to 13 years in 2009, but he just got off last year in 2015. Serving only 5-6 years on a 13 yr jail time? He got off for good behavior but I think prison overcrowding worked in his favor. I mean he's just a suburban white kid who posted himself chugging 40 oz.

This is why I stopped using the AUX cable to play songs through my phone. I was also involved in a crash because I was changing songs on my phone. Luckily for me, it was a very minor crash. I just use CDs now.

I've heard of a similar situation where an old associate of mine while drunk ran his penis into his own mothers poon. He didnt get in trouble or anything because his mom actually liked it. I seriously feel these situations are sick sometimes man, and these kinds of people should be held accountable.

Texting drivers are just as bad or even worse than drunk drivers. At least dui drivers have their eyes on the road. Seen texting drivers before swerve into other lanes, run red lights, almost hit pedestrians in crosswalks.

Prison isn't just for a deterrent or to teach someone a lesson to change their behavior. Its more often than not a punishment. Good ol' fashioned emotional revenge.

So when the drink spills on you, and you look down and take your attention off the road, you just naturally look down to see what kinda mess you made. With hindsight we would keep our eyes on the road until we found a safe place to stop before looking down at the mess.

Distractions are something that can happen, we don't WANT to get distracted, and if we had a choice to cancel distractions from happening during periods of driving, that's something we would do.

If a woman lifts up her shirt in front of you, and your eyes gravitate towards her boobs, would you say you consciously decided to look at her boobs? If you touch a hot pan accidentally, and your hand flinches away from the pan, did you consciously decide to move your hand? No.

The difference between what the driver and a mass shooter did? One intended to kill people, the other got distracted and accidentally killed people. It's really not a good comparison at all, so not sure where you are going with this.

I dunno about the batman shooter case, but assuming he sprayed into a crowed, intending only to kill 3 chosen people, instead killed 9?

But if so -

That's like poisoning soup with the intention of killing 3 chosen people, knowing that those 3 people eat from said soup kitchen every night, however having full knowledge that hundreds of other people come for that soup every night and knowing they would get killed too.
