I know the misc has some lawyers, and other experienced people in here so I wanted to see if anyone has any knowledge on this while I’m doing my own research and trying to find a lawyer if needed.

I have a 2018 panamera turbo(you can see it in my post in car thread or I’ll post pics when I’m home), it’s valued at over 185k, a delivery company hit my driver door, mirror and scraped the passenger door. The damage is basically needing another door, repainting and fixing back door. Originally the company didn’t want to take responsibility because I didn’t have the witness and etc but after lining up the truck with the damages and submitting to their insurance company they have agreed to paying out.

They are only talking about paying 900.00 at time for repairs for some reason.

My problem is they will be reporting the damages to my car history per their regulations and etc. Having body work especially if for some reason it says collision or others negative explanation, would diminish the value of my car. I would assume any person especially dealer will want to take money off anything possible on a vehicle that costs that much.

I have heard of diminish value claims, but to my understanding you have to sue for that, and on reddit thread I was told that the delivery companies insurance only pays for the damage to vehicle won’t pay out diminished.

Has anyone been in a situation like this with being hit by a company to their new car?

EDIT: Had the chance to upload images of car per misc rules lol, and pictures of some of the damage lined up with the truck that did the hit and run.





EDIT: to save the confusion of thinking I don't have a garage

Car is still daily driven, mainly with an infant in it so yes I expect it to be possible for things to happen to it, and don't care about that as long as i had some type of fault in it, so it would be stupid to just chalk up having my cars diminished value from someone else fault and accept that.

UPDATE: As many in this thread are talking about the value would not be diminished much and acting as if me wanting to pursue it is means I cant afford the car. That's a 13k hit, only an idiot would just leave that on the table because "its going to be worth less in a few years".

It doesn't devalue your car unless it's structural damage. The Panamera Turbo won't hold long term value like a 911 will either, unfortunately.

Allow me to play doubles advocate here for a moment. For all intensive purposes I think you are wrong. In an age where false morals are a diamond dozen, true virtues are a blessing in the skies, and are more than just ice king on the cake. We often put our false morality on a petal stool like a bunch of pre-Madonnas, but you all seem to be taking something very valuable for granite. They would bring it up but as long as it's non-structural and repair is done by Porsche/Authorized, they wouldn't have much of a playing card. It's not a garage car so aesthetic damage is expected anyway.

I've never been in this situation but I have enough common sense to know the company's only gonna pay the minimum that they have to.

IDK about the whole diminished value thing, but LOL if you think the company's gonna be the one to pursue that, they're not gonna proverbially "hang themselves".

So how did they manage to hit both sides?

Doesn't sound like there is any structural damage so when you go to sell it either to a dealer or third party, if they come at you with some kind of reduced offered due to the carfax, just tell them what happened and to pound sand.

As for filing a claim for the diminished value with their insurance company, go for it. All you have to do is ask and they have to pay out but don't expect much. They way they underwrite that payout is a ****ing joke. You'll get $99.

It’s not being done porsche authorized, insurance wants to basically pay cheapest option and since they are putting a new door on. I guess I just assumed garage car or not, with it’s value AT THIS TIME(not years down the road as people are mentioning) if I wanted to trade it in today, or sell it private that no one is going to pay the same for it with damage on history versus a car without it, not at its price range if that makes any sense

I can't see how it wouldn't affect a resale - if not in price at least in scaring away potential buyers. Let's say in 5 years you go to sale and it's around a 50-60k car by then. If you have $60k to drop on a car and you find 2 -- one that's been wrecked and one that has not which one do you buy?

At a minimum:
1. Take tons of pictures of the damage so you can show future buyers exactly what was damaged.
2. Shop around and find the best repair shop obviously
3. Make sure they do the proper paint job -- going to have to paint at least that whole side of the car to get a good blend.

I just posted in attachments what’s hit the vehicle, originally they hit my mirror pushing it in and then dented the door, when pulling away the back of the railing dragged a little to the passenger door.

They are already making things a bitch as they only want to pay a few hundreds of the repair at a time even though they have the full estimate, which in turn isn’t going to make the original 9 days not including weekend repair, last weeks lol

Very, very, very rarely does a car that was in an accident drive the same, why do you think **** like Carfax exists?

I'd bet it was because people were getting tired of being sold cars that passed the eye test but drove funny.

Yeah insurance companies are *******s. You won't lose a lot of value on your car for this. In the overall picture that door holds nowhere near the value of the engine, drivetrain, electronics, etc...

Buyers will manipulate the chit out of sellers for any little thing they find, so yes, someone may go HAY Y DO U HAVE ACCIDENT GIMME CAR FOR 3 DOLLAR. It's just going to be up to you to explain that it was non-structural and just the door. Assert yourself and don't be in a situation where you NEED to get rid of the car, otherwise you'll get chit on.

There's really nothing you can do here that you're not already doing. While you an attempt to sue the delivery company for damages not paid by the insurance, the cost of the suit is likely to exceed your recovery. Also, you're going to face an uphill battle proving damages in court, and the suit may become effectively moot if it takes several years (as is common) and the value of your car diminishes due to age.

Sorry man, but this is one of the downsides of having a really nice car.

I would try my best to force them to get it repaired at an authorized dealership. Anything less and its going to look like a backyard fix and I can def see that turning potential buyers away.

I have pictures of damage, along with investigation pictures with delivery company truck beside it showing it lined up.

Yeah I can’t understand how it does not hurt the value when there is no way I’d spent 6 figures on a damaged vehicle and want nothing off by just them saying it was only door damage, when spending that much your expect the vehicle to be as good condition as possible. Yeah I can tell private buyers I’m not going to give anything off but that also limits my small potential buyer pool even more.

They are going to blend paint and etc but I still will have to go 10 hours away to get painted protection that’s on the rest of my car on the new pieces as the insurance said I need to take it back to the original protection place and they would be who warranted it

Why are you giving them that option? They are not in charge of where you get your repairs done. I would take it to Porsche and then they can deal with the insurance company direct. Take yourself out of the equation.

Yea I don't see this majorly affecting the value, if it was a side impact. You could attempt small-claims and present your case there, this will avoid lawyer fees. But you are caped at how much you can sue for because it's small claims.

Check your state laws to see what the max is and go for max if you want to do this, if the judge rules in your favor you'll probably get somewhere in the middle, if you lose no lawyer fees just the time.

Be prepared: Bring evidence and other examples of people who lost long-term value on their vehicles due to side impact damage similar to yours. This will be the hardest part, producing real evidence to back your claim.

From looking at diminished value claims online it says that if I take vehicle to dealerships and get estimates of what they’d offer compared to what’s the blue book or other site values of the car without damage that says how diminished value would be found for a NEW vehicle which my model is considered, but that was with normal accidents, I’m not sure if because it’s a company that changes drastically.

I do understand they try to draw out things as long as possible, i would hope they’d just not want to go through that and be willing to compromise at some point. Looking at natural diminished by value from age, I don’t think should come into play until 2019 models come out next year.

I don’t really expect anything to come from all of this but definitely wanted but people’s opinions

Take the name of the insurance company and claim info to your friendly Porsche dealer and ask them if they are interested in doing the work. I'd wager they have someone on their staff that has no issues dealing with insurance companies and making them pay to get the job done right - we pay a lot of money to insurance for that exact reason.

Take a chit ton of pics already suggested and keep that as part of the file on the car and anyone that questions the work you can show them exactly how superficial the damage was and that you had it repaired properly. You'll also have a detailed list of all of the work that was done, bam.

Originally I was looking to get an estimate, the first and best recommended place said they do not report to history so I was fine with that, as it’s replacing door and repainted didn’t think that was a precedure that required porsche authorized and was trying to avoid it being on history, I just got told before the post their insurance will report it, so now I will be trying to do porsche authorized although it’s going to cost more in which insurance is likely not want to pay because they want to always do cheapest possible fix but if it’s going to be on my history then I definitely need porsche to fix it.

I’m definitely going to stand my ground, As much as I paid for this and it waited almost 6 months for my custom build

The real question is how much does it diminish the value?

First off OP you weren't gonna get $185 K for the car, that number probably realistically meant more like $175 K or so.

But now with the accident I wouldn't be surprised if potential buyers wanted to start the haggling at $150 K or even less.

Meaning I'd see you getting something along the lines of $160 K.

Disclaimer: I haven't done research, it's all just a made up scenario that I figure is very likely.

With the build of my car I paid almost 185k for it with 15% off. I don’t know the exact value and didn’t want to try to oversell things just trying to look at it from the basic aspect of 2018 panamera turbo damaged versus 2018 panamera turbo no damage reported, which one is someone going to pay price for. Yes I understand natural devalue and etc but I’m purely looking from it at the standpoint of if i sold it before a 2019 version would I have lost out on money because of the damage.

No I don’t need to sell the vehicle and possibly never would, but the fact that someone else is at fault for hitting my parked car and if for some reason period I did want to get rid of it there is still some type of value lost to it. I can turn down bjhers who would like money off but if I did need to sell it, I’d be ****ed if I could not find someone who thinks “ 6 figure damaged vehicle ohh it’s just door damage I’ll pay normal price” .

Yes, the value of your vehicle is diminished even if there is no structural damage. But, I was able to get the other persons insurance company to pay me a diminished value amount on top of the amount to fix my vehicle since the damage done was not my fault. The amount of diminished value is negotiable. So don't settle for the insurance company's first offer.
