Depends on circumstance. Driver can easily say he was distracted last second by the parked vehicles blocking the roadway and in an attempt to avoid crashing into them, he swerved. He could then say he noticed the people walking in the roadway last second and could not avoid it. Most, if not all statutes will say you cant intentionally block or impede traffic. Take that plus night time driving at a high rate of speed and it spells disaster, unavoidable disaster if he can articulate it well enough.

It'd be an easy case tbh. The protester can claim whatever he or she wants to claim all the way up to homicide, but the defense lawyer will get paid lol.
