At first I thought he pushed the guy hard out of the way, but he actually just did what most of us would do at a guy not looking. And while he was walking, the guy started mouthing off to him. That's where Joe will claim the guy made threats at him and turned around because he was concerned about his safety. And when the drunk guy squared up and made a move towards Joe, that's where Joe will claim he had no choice but to defend himself.
The issue here is that Joe is an idiot for posting that message on social media.

And he's gonna claim the reason he goes up to the guy is because he wanted to make sure of what the guy was saying. And during that exchange, that's where you see the guy feint a move towards Joe. That gives Joe all the incentive he needs to claim self defense since it was the drunk guy that threatened him. And then made the first threatening move.
Whether a judge buys that, I have no idea. But that's what Joe and his lawyer is going to claim. Again read my original post. I'm not saying Joe is in the right here. Just that this is what I see in the video and how they're gonna play it.
