Yes. If it's correctly applied then a person will be out after about 10 seconds. You're almost immediately affected, weakened, and your window to escape is very small. You don't have much time.

If the receiver is defending successfully that might be a longer, though. But eventually they will succumb to even a partially applied blood choke.

Once a person goes unconscious, if the choke remains they could die in 1-3 minutes. They're getting no blood to the brain.

If someone holds a rear naked choke on someone for 10-15 minutes then most likely they have no idea what they're doing or they're trying to kill.

There's been cases where a kid would hold a choke on someone trying to copy pro wrestling and they died. They didn't know what they were doing. Seems harder to believe an adult wouldn't know what is likely to happen if they keep choking someone after they go unconscious.

Idk what the defense will be considering an unconscious person can't be a threat.

It's a textbook case of murder imo. The guy didn't attack anyone, and while he was acting angry and yelled a bit, killing him was out of line. I don't see a jury giving him a pass on this. Depending on circumstances, one can argue the homeless dude was committing assault and the intervention was warranted. It still likely wouldn't justify lethal force. He will be held responsible for the death even if he didn't intend to kill him. At the very least, it's manslaughter. At worst, it's murder.

I think the charge is fine, and the jury will definitely convict on this charge.

That is kind of where I stand. The guy was acting erratically and I have no issue with citizens doing something about that if they feel endangered. The issue comes in when does the subduing become excess??

Having a brother growing up who I got into little fights with and wrestling in HS etc.....a person can tell when you have a chokehold on someone when they are starting to weaken and lose consciousness. In this case he held him for a very long time (15 minutes???) and common sense tells you that is a very long time to have your arm around a throat. He also had other citizens there who were helping where he could have let up on the chokehold and they could have all held him down together without choking him.

So while I APPLAUD the guys efforts, IF you are going to involve yourself in something like that you have to be smarter...especially since it appears the guy was not actively threatening people and especially especially after the GF incident where YOU KNOW the left is going to look for anything to try and show how racist whites are against blacks.

Tough situation.
