Tinyeye still picks up on that, but that's only really a problem if the pics are used as avatars or widely posted on forums for whatever reason.

No you can't. It's not a criminal offence. If she took you to court privately, she'd have to have a lot of money (we're talking very wealthy, multi millionaire rich and she clearly is poor, she can't get legal aid for this type of problem), and all she would get at best if she took it to court is an injunction for the video to be taken down. See my last two posts on the thread. I'm not a lawyer but have an English law degree. In your situation, it doesn't matter what you do.

The right to privacy in English law is very weak in comparison to defamation. The law really comes down to the HRA 1998 - and the Court doesn't award damages for infringement to privacy - this is in fact said by Justice Eady at the end of Mosley - only exemplary damages are possible which is a compensatory remedy - in Mosley's case since pictures and libellous comments had been published in the News of the World which destroyed his career and personal life - his son actually committing suicide. These exemplary damages are exceptional do not apply here. Here are the relevant cases:

I don't think deleting the thread will help much. I'm not a lawyer but I think if it came to a court case, BB.com could be forced to retrieve the thread (keep in mind, if YBD doesn't do it, some misc detective will undoubtedly aware the girl at some point). If they delete it permanently, I think that's deleting evidence, no? Pretty sure that's not a good idea.

But like someone above me said, it's the UK, not the USA... YBD isn't very likely to get in legal trouble. Hopefully.

There's a good chance that nobody will take legal action against YBD but there's no point in exposing yourself to the risk.
