There are very specific steps police need to take in order to secure a conviction and a combination of their incompetence mixed with you not telling on yourself can work in your favor easy.

Remember, police can only lie to get your cooperation. By that I mean they can try to get you to give up your civil liberties and tell on yourself. They can lie to you, but they can’t lie on a statement as if it is a fact or lie to a supervisor to create a crime that doesn’t exist and often times they do not draw that line for themselves. If you don’t plan of giving up your rights, which you shouldn’t, then lying has literally not impact. It is irrelevant. You should absolutely always assume a cop is lying. Assume they are lying about the what evidence they have, assume they are lying about the authority they have, assume they are lying about everything.


Always record. They cannot stop you. They may try, that would be a blatant violation of your constitutional rights.

It can be easy to get a case thrown out due to rights violations, but unless you actually take the time to educate the cop on the spot and. You can prove that you did that, they will not get in any trouble. Some people are okay with that but I always make sure they are held accountable. So I educate them.

Next time I get pulled over (hopefully there is no next time), do I refuse to answer any questions like "where were you, did you have anything to drink" and then also refuse the field sobriety test?

I feel like the State Trooper decided to arrest me as soon as he smelled alcohol off me

Then the question becomes how do I mask that smell? Do I just use mouth wash, cologne, air freshners, and chew a fuck ton of mint gum?
I refuse to die until things are better... and THAT IS A THREAT!

Yes.

Evoke your civil liberties immediately and often.

If you engage in casual conversation with a cop, then when they get down to business and say something about the stop and ask you, and you go quiet, that silence CAN used you against you.

Additionally, they have their own agenda they are trying to accomplish. When they ask you where you are coming from, you know that you were not committing a crime, so you answer. They were literally just looking for evidence that you were on a known drug trafficking corridor. Dead fucking serious.


Additionally, you can’t just sit there and be silent. You have to say that shit. You have to get some balls, and tell the cop no. They will keep pressing you even if you say you will not answer questions. You can make them stop. If you say you won’t answer questions without legal representation, they have to stop asking you questions. Additionally, if you ask for a supervisor, they have to call one.

Here is the polite way…
“With respect to you as a person and your position as a law enforcement officer, I am evoking all of my civil liberties without exception. I have provided all legal documentation I am required to by law and I will follow all lawful orders. I will not answer any questions without legal representation, I do not consent to any search or seizure”.

I go much much farther including putting them on notice “anything you say can and will be used against you in a court of law”, but I have a big dick and lots of practice.

You can legally do this in a much more aggressive manner if you want the conflict. Which I think people should experience. Establish and enforce personal boundaries. It is healthy


All of this needs to be recorded. You have to record every interaction with cops.


There is no need to be polite or nice at all. Don’t let them shame you or scare you. Know your rights.

Legally, not participating cannot be used as evidence of crime. Due to psychological concepts like confirmation bias (they have already decided you are drunk), they will find evidence of you being drunk during FST.

DO NOT TAKE FST, THEY LITERALLY CANT DO ANYTHING TO YOU FOR REFUSING. THEY CANNOT LEGALLY COMPEL YOU TO. THEY WILL ONLY BE USED AGAINST YOU.

This. It's one reason that if I do drink, I am not driving for at least a while because even if you are below the limit, if anything happens, "alcohol is a factor" They can give you a DUI even if you are below the limit if you fail the sobriety test and while a lawyer can probably get you out of it, it's not going to be free or even cheap.
