A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.
If I'm understanding it correctly so far .... they clearly -thought- they had grounds for making a citizen's arrest because they were on the phone with 911 to that effect. Whether that actually shakes out or not legally will probably be based on a long drawn out rehashing of all the facts and evidence like the Zimmerman trial.
... and then as to the shooting itself - if their attempts at citizen's arrest were lawful, then the use of deadly force became justified once Arbery attacked the elder man with the shotgun and tried to disarm him of his shotgun. Their attempts at citizen's arrest may not have been lawful however, and if that's the case then it would change from a justifiable homicide to then being an aggravated assault followed by murder.
It all will depend on a lot of facts and evidence about what Mr. Arbery did or didn't do prior to them trying to stop him, and what the McMichaels did or did not witness or know about directly .... facts which we don't know all of yet and/or can't be sure of yet and that will have to be drawn out at trial (unless there is a plea).

Two burglaries had occurred in the Satilla Shores neighborhood in 2020 before the shooting.[17] Only one burglary was reported to Glynn County police between January 1 to February 23, 2020. The theft was of a pistol from a pickup truck outside Travis McMichael's house on January 1, 53 days before the killing. His father, Gregory McMichael, had not locked the truck in the morning, and an hour later, Travis discovered that a Smith & Wesson M&P 9 mm had been stolen.[24] The other burglary was some 30 days prior; $2,500 of fishing equipment had been stolen from an unsecured property that was still under construction, but the owner had not informed the police.[17] Starting from October 2019, the Glynn County Police Department had been called to report a trespasser on the site of a nearby house under construction.[25]

Activities before the shooting
On the afternoon of Arbery's death, he entered a house under construction, triggering the owner's security system and recording video. Arbery's aunt subsequently identified him on the owner's video, saying that he was "looking, not stealing anything".[17] However, Waycross District Attorney George Barnhill wrote that there is video of Arbery "burglarizing a home immediately preceding the chase and confrontation".[3]
Gregory McMichael told police that he was on his front lawn when he saw Arbery running past, "hauling ass", and that he recognized Arbery from prior incidents, including one where he had reached into his pants as if for a weapon. Gregory brought a .357 Magnum revolver, while his son Travis brought a shotgun as they pursued him in their pickup truck. A third man, William Bryan, followed close behind in his own vehicle while recording video.[26][5]
Emergency calls
There were two calls to 9-1-1 made minutes before Arbery's death. Neither call alleges a crime committed by Arbery.[24] The transcript of the calls were provided to The Brunswick News, with the callers' identities redacted.[24]
In the first call to 9-1-1, a male caller said another man was in a house that was "under construction". The 9-1-1 dispatcher asked if the man was "breaking into it right now?" The caller replied: "No ... it's all open." After the caller said the man was now "running down the street", the dispatcher said police would respond. The dispatcher then asked at 1:08 p.m.: "I just need to know what he was doing wrong. Was he just on the premises and not supposed to be?" The caller replied in a garbled manner: "And he's been caught on camera a bunch at night. It's kind of an ongoing thing." The caller identified the man as a "black guy, white T-shirt".[24]
In the second call to 9-1-1, beginning at 1:14 p.m., a male caller said: "I'm out here at Satilla Shores ...There's a black male running down the street." The 9-1-1 dispatcher asked: "Where at Satilla Shores?" The caller replied: "I don't know what street we're on." The caller was then heard shouting: "Stop! ... Watch that. Stop, damn it! Stop!" The dispatcher tried to speak to the caller but did not receive a reply for several minutes. The caller later hung up.[24]

Logic and facts have never been your guide. Ever since accounts of police brutality against blacks have surfaced, your camp’s MO’s remained the same - scrape the victims’ backgrounds to dig up as much dirt as possible, and then weaponize it to shut down any chance at discourse. Thefactthat police are engaging in horrendous abuses of power is never addressed. Thefactthat this violence is only ever perpetrated against the poorest and most vulnerable elements of our society is never addressed. Thefactthat anybody with an ounce of common sense can see that the book’s thrown hardest at a certain group of people is never addressed.
Again, you can keep pretending to be this impartial arbiter all you want, but there are very real feelings of oppression bubbling underneath the surface.
