Once they send it to a body shop for an estimate and they add everything up especially the headlights it's gonna be over the limit

I had a 2nd car that my father was driving, and it got hit. Also didn't have full coverage but since it was the other person's fault their insurance did cover it but it took like 4 months and they tried to fukk me during the process every way possible (it was statefarm).

- First off, they didn't admit fault and without a police report, I would have had to hire a lawyer for sure.
- I had to buy the police report (paid for it myself because they were slow af and said there was no report yet but there was)
- Their insurance told me I should pay to have the car towed and they would reimburse me
- Their insurance told me I had to pay for my own rental car and they would reimburse me

I called my insurance company for some advice and they pretty much said don't pay for chit out of pocket because it will be hell getting it back. Only thing I paid for was the police report, and guess what... I never got that $25 back lol. 4 months later though they finally settled on totaling the car and paying me out. Absolutely ridiculous process though

Would be pretty hard for them to say it was not her fault considering the police report will say she hit a parked car and my car being parked in the parking lot while she was operating hers but you never know with these scummy insurance companies which is what has me worried.

I have the money for a lawyer i am just hoping it won't come to that ...really hoping this won't turn into a headache.

worst case scenario is sue her..... wouldnt be small claims so at least where I am wood be the Court of Common Pleas for anything over $7.5k

Good thing is the last case I won the judge heard arguments over the phone (sued some dipchit who plowed in to my F150 at 3am........ but in doing so his bumper with license plate fell off)

I called my insurance Gaico and they said its best to work with her insurance since i have liability coverage only...thats how i found out i only have liability on the car when i was like 100% sure i had full coverage and was not worried until they told me that., I figured worst case scenario i get my insurance to pay for it and have to pay the deductible but now i may be at risk of losing at least $5 000 possibly $15-$20k if it is totaled.

i think you're prob alright since she's admitted there's been an accident; meaning its on her

BUT i'm not sure it means her insurance has to pay

this is one of those things that can fuk up your life real good

think there's a scenario where you'd have to sue her civilly

not sure why the cop didnt issue her a citation if she admitted to it. maybe because it had been so long and there was no 100% proof she did it?

first off there is 0 reason to call the police

1) its private property
2) she did what the law requires which is exchange information
3) this is a civil property issue not a criminal issue, police dont deal with civil issues.


second, her insurance cant give you a runaround. She hit a parked car. Thats flat out just her insurance needs to provide you with a rental and repair. just make sure you understand the terms of the rental and the repair and the timeframes they allow.

if someone is getting mad the police is involved makes me wonder what are they hiding, police simply take a statement of what happened, both drivers licenses (usually) / insurance policies and they give you a case number to give to the insurance and they're on their way to do whatever they do, nothing more nothing less.

police is not the fixer for an accident but having that report makes it so much easier for the insurance agent

Myself personally I could fix that myself for 1k using CAPA aftermarket or 2K using OEM parts with my hookup. I've had to fix worse before (crushed radiator support and bent frame rail).

That being said if the report puts her at fault ie: hitting a parked car then her insurance has to take care of it

It doesn’t matter if it’s private property or not. You’re not vindicated from a crime because it’s on private property. Yes, it’s illegal to smash into other peoples vehicles.

it is illegal to smash into someones vehicle and leave the scene without leaving information

it is not a police matter if on private property two vehicles privately owned get into an accident and parties exchange information.
At that point it is 100% a civil issue and has nothing to do with the police, insurance companies just want to rely on police and that makes police do extra work that is not necessary for them to do and they dont act on behalf of private insurance companies so I could give two flying fukks how easy it makes it for insurance companies, taxpayers pay my salary not insurance companies.

Not most. Most states explicitly prohibit private property crash reports unless it's a hit and run/dui. Theres no value in calling but of course check your local state law. I dont care if it's easier for a claimant. It's not a police issue.
