It's a simple fact that the level of compensatory damages in this case are wildly out of proportion with what any actual damages may have been. That alone reveals a lot about the jury's thought process.

Why would I need to when Rudy Giuliani's own attorney admitted there was actual harm and was just complaining about the amount? You are trying to argue something that even his attorney didn't contest. Please continue to contest something that even Rudy's defense attorney isn't contesting.

Defense attorney Joseph Sibley had told jurors they should compensate the women for what they are owed, but he urged them to “remember this is a great man.”
During opening statements on Monday, his attorney Joseph Sibley acknowledged that some harm was done to Freeman and Mossand that the jury would be awarding damages against his client. But he argued that the amount sought by the plaintiffs far exceeded what Giuliani should have to pay them as a result of his conduct.

Phil, I'm a trial lawyer. Top producing partner at my firm 6 of 8 years. I'm asking about damages. Show me evidence of damages. An attorney admitting liability is not the same as admitting to specific damage amounts. Show me evidence of monetary damages. I've never once said he didn't defame them - I have said and continue to say show me evidence of monetary damages.

Congrats, I’ve also been a lawyer for years. Big deal. I even said you can argue the compensatory amount but you can’t argue the liability (Which you started out by doing and I even quoted you as doing). The amount is irrelevant to the fact he was indeed found to have caused damages and his defense attorney didn’t even try to deny it. Maybe Rudy shouldn’t be breaking the law if he wants to avoid getting sued in civil court?

You claim the jury has an agenda but are in total denial over Guiliani’s actions that he himself didn’t even bother to defend in the courtroom. I’d say you are the one with the agenda since you are trying to defend an individual whose own attorney admitted was liable for damages. You should probably do a little self-evaluation there, Attorney of the Year.

You must not have done much if any private practice or trial work. If I walk up to you and flick you on the forehead, I am liable/have liability for the damages I caused. The burden is on you to prove what those damages would be. That is done generally through the production of medical bills, pain/suffering testimony, etc.

Here, I'm asking you to show the evidence that support a compensatory damages finding of $16M. You have not done so because you can not do so because it's a completely asinine number.

I also lol at you repeatedly drawing negative inferences at Rudy's decision to not take the stand. The Judge had already found him liable, as discussed ad nauseum, the only issue the jury was deciding was damages. What information could Rudy possibly give the jury about those womens' damages, again with the burden being on them to provide such evidence? The answer is none.

Not to even mention that you should never draw a negative inference if a defendant does not take the stand, even in a civil jury trial. That's an incredibly basic jury instruction that if you had any clue what you were talking about you'd be aware of.

Days after being awarded $148 million in damages against Rudy Giuliani in a defamation suit, two former Georgia election workers have filed a new lawsuit against the former Trump lawyer over remarks he made about them immediately following Friday's verdict.

The new suit by Ruby Freeman and Wandrea “Shaye” Moss seeks a court order permanently barring Giuliani "from persisting in his defamatory campaign" against the mother and daughter pair, arguing that he's continued to falsely accuse them of committing election fraud even after a federal jury handed down last week's verdict in Washington, D.C.

The lawsuit notes that Giuliani told reporters after the trial that his long-debunked allegations "were supportable and are supportable today." He also told Newsmax that "he was in possession of video evidence demonstrating the truth of his allegations."

In Monday's filing, attorneys for Freeman and Moss said they'd asked for Giuliani to stop smearing their clients, and said he would not.

"Before filing this lawsuit, Plaintiffs’ counsel asked Defendant Giuliani to enter into an agreement to stop publishing these and any similar false claims about Plaintiffs. Defendant Giuliani refused," the filing said. "Defendant Giuliani’s statements, coupled with his refusal to agree to refrain from continuing to make such statements, make clear that he intends to persist in his campaign of targeted defamation and harassment. It must stop."

The suit doesn't specifically ask for money damages — just "a targeted injunction barring Defendant Giuliani from continuing to repeat the very falsehoods about Plaintiffs that have already been found and held, conclusively, to be defamatory."

The suit accuses Giuliani of defamation and intentional infliction of emotional distress — two of the same claims the plaintiffs successfully sued him for in the same federal courthouse.

U.S. District Judge Beryl Howell in August found Giuliani liable for defamation after he snubbed multiple court orders to turn over required evidence to Freeman and Moss.

Giuliani had repeatedly accused the pair of election fraud in the wake of former President Donald Trump’s 2020 loss in Georgia, and circulated a brief, heavily edited clip of security footage that he told a legislative committee in Georgia showed them passing USB drives “like vials of heroin or *******” during ballot-counting operations. Moss said the “USB drive” was actually a ginger mint.

Freeman and Moss said they were subjected to a torrent of harassment and threats from Giuliani's smears and were forced to leave their jobs.

Seems people who don't even make the average wage think a little distress is worth millions. It used to be that you would be liable for damages, and some was added for emotional destress, but what are these people worth? They are trying to do the same for trans people if you misgender them, even by accident, they want some type of restitution.

Imagine this, down the line, some guy comes in and you call him sir, now you have to pay him $10,000 because it turns out he was non-binary or some chit. I would srs kill someone before I'd pay it. That really is the answer, when these people start seeking these types of things, bad things happen to them.

It's one thing that is degrading morale in this country in my opinion. Everywhere you go, you see people who aren't that smart, who don't even do anything important, making money hand over fist, just getting paid, while people who are smart, highly skilled, do important work, are literally facing hardships and poverty, barely able to scratch by. Criminals are hailed as heroes and victims, given a pass, while honest people are penalized and ordered the walk the line and called criminals for just not accomplishing great expectations. It's like, WTF is the point of doing the right thing. There is no incentive anymore.

Throwing out a non-answer was the best you could do at this point. Not really fitting for the supposed lawyer of the decade at his firm. Do you struggle this badly with contradicting yourself and inept reading comprehension on the job too? You must work for a bottom tier firm.

The irony is palpable. You still can't provide one shred of evidentiary support for why they deserved $16M in compensatory damages. Keep deflecting.

I don't need to. I already stated you can argue about whether the amount was correct in the judgement.
