The problem isn't the HOAs usually, it's the management companies they hire to do all the work. They usually get a fee for each violation letter they send out.

Our previous management company was sending out completely absurd violation letters and the board asked them to allow to filter out the really stupid ones before they mailed them out. The response: "Nope. We've got a contract." That contract wasn't renewed when it came up, but they continued printing money until it did.

TBH the people who choose live in HOA communities, also choose to be told what to do by those hall monitors.

Can confirm. I enforced deed restrictions for 1800 homes at one point. The board of directors would often demand that I be more strict, which would lead to residents upset because they felt harassed (which was a fair complaint).Then there's the mishandling of funds…

I'm not sure how the HOA could lose this lawsuit. They didn't really do anything negligible by upholding the rule in place. The women still chose to go walk next to the pond and f*ck around right on the edge with the gator approaching. There's a ton of grass there that it wasn't remotely necessary to be that close.
