there are some talks out there that HF don't close positions on bankrupt companies do they don't have to pay taxes on it while using the unrealized gains for leverage…

HF doesn't have to cover = total profit


As for the capital gains tax, a retail investor with a short position would have to pay capital gains unless trading in an IRA.


I believe hedge funds however have a loophole where they can avoid taxation by using carried interest, which allows funds to be treated as partnerships.
Funds are also able to avoid paying taxes by sending profits to reinsurers offshore, where they grow tax-free and are later reinvested back in the fund.


So shorting into bankruptcy is basically hitting the lottery for hedge funds/market makers. The real issue is lending out naked shares to further increase the likelihood of bankruptcy through additional leverage.
