I've been around guns my whole life. The first day I picked up a firearm, I was told before to check it. I was taught all firearms are loaded no matter what anyone says. I was also taught never to point a gun at someone, especially with my finger on the trigger, unless I intend to kill that person (I was also told to make sure I am never in that situation).

These are the most basic firearm safety protocols, and anyone around any firearm, prop or real, should know/practice them. This was negligence by every party involved, but not murder. That would involve some form of premeditation.
