You're grasping here. It's very different for the NYT to claim something was declassified by a tweet than for the president himself to say it was declassified. The issues comes down to the fact that if the CIA were trying to sue Trump he could just say he declassified the documents via the tweet; the NYT can't say that since they can't read his mind or know his intentions. This is established in federal court rulings specific to the presidents handling of classified documents. They went so far as to say that even if the material was still classified there's nothing that could be done about it because no one has authority over them that supersedes the President's so there's no possible remedy. All we're really seeing here is some very irresponsible people drunk on power trying to take out a political opponent.

There will likely be legal retaliation against Democrats. Politics is supposed to solve issues without violence but using courts to attack and imprison an appointment is violence.
