I live in a better country than USA where the police is actually helping people and the criminality rate is even lower than your testosterone levels after reaching andropause. Very, very low, that's why we don't have prisons.

You have this idealized perception of the US, but it isn't reality. You absolutely DO have to show your papers when walking down the street or driving and law enfocement IS above the law. We have seen this proven time and time again in this country.

I'm confused how a cop saying "hey can I ask you a question?" As referenced in the OP is harrassment? Did we twist this into something extreme where the cop in the OP is doing anything other than that?

Mind is blown at how many people ITT don't know their basic rights in the USA. It's these same people that scoff at the videos on the interwebs of people standing up to unlawful drunk driving and immigration checkpoints. If you don't stand for your rights you will lose them. And if you think government is your friend... well there is plenty of historical evidence and modern day evidence to prove it is not. Disagree? Canadian criminal lawyer but I imagine the laws are the same.

Cop has to have at least reasonable suspicion and that would mean you are being detained.

Ask the cop if you are being detained. If he says no, you are free to leave.

If he says yes, you have the right to a lawyer right away.

If he doesn't answer the question, or does so in a weird way, which makes it seem like you are being detained and you do not know it and do not have access to a lawyer, anything that comes from that search will not be admissible as evidence at prima facie.

E.g. If you ask if you are being detained and he says something like "Well, I need you to talk to me and if you don't it will mean trouble". Technically he didn't say you are detained but created a situation where you pretty much were. If he found drugs and illegal guns, etc on you at the point, it would be inadmissible and the charges would get dropped. In Canada, if the found something from the search that led to the discovery that you murdered somebody, it would probably be admissible because they would balance things like the degree of breaking of your Charter Rights to the seriousness of the crime.

It's heavily dependent on the facts, statute of the state, and previous caselaw.

In summary, the answer is: It depends.

If I have done nothing wrong and he wants to delay me in any way it's being harrassed.

No different than a bum on the street stopping me to ask for money. I consider that harrassment too.

If thats against the law what type of rewards would i get from them for being wronged? (As in they had no right to stop me in the first place)



The way I see it a reason of suspicion can be fullfilled if you run or walk away when they talk to you.




Also fighting police with BS like "you cant do that MUH RIGHTS" just invites them to log that **** in their computers and **** you up the ass with traffic stops everytime they see your license plate on the road.

As in no more warnings for going 1 mph over the limit. Now its just max fines.

You don't have to carry ID if you aren't driving. You only have to give your name if officially detained and you simply ask if you are being detained.

If they say yes then they have to give you a reasonable reason for your detainment. Once they do that they get about 10 to 15minutes to either arrest you or let you go.

You are only required to give them your name.

Driving is a different story. There you have to provide ID as driving is a privilege. But even then they have to provide you with a reason they stopped you.

The government has very little need to interact and know anything about me.

That's what this country was founded on.

A cop is there to do his job but his oath is supposed to uphold and not violate the constitution.

The oath I took was to protect the constitution against all enemies foreign AND DOMESTIC!!!!!

That includes cops that violate the constitution.

if you just say no i'm busy and keep walking no big deal. but if you just ignore them turn around or start running, that is pretty suspicious and you'll probably get detained
