Well, he could have done it. He has probably been drinking alot these year and that's why he has aged so badly. So perhaps he was drunk and hit her. But as Sean Connery said, "if you have tried everything else, women are pretty good at this. And since his mother died and 3 days later she files a divorce, who knows if she was beeing provocative and saying all kinds of horrible stuff to Johnny which then resulted in him hitting her. Not saying that makes it right to hit a woman/ someone. But some people think they can get away with some horrendous stuff, and if she perhaps said something about his deceased mother, maybe he snapped and she then saw a situation where she could benefit form that.
Either way, I think they should get a 100% proof that he did it before giving him a sentence.
