You should head to the most prestigious law firm in your area and apply for an attorney position. Bless them with your reading comprehension and surely you'll get the job and be on the route to partner in a few years... making a few hundred thousand to a million per year. Surely better than whatever route you're on now.

Correct. If he saw a gun, then his actions might be deemed reasonable. You are right that in practice, there are ways to escape consequence here. However, we both can be fairly sure there was no gun. You can actually see everyone in the vid pretty easily. Those people had phones out, not guns.

Becoming a lawyer is a terrible career decision these days. Many lawyers end up being forced to work as legal assistants. I used to want to be a lawyer a long time ago.

You realize there are multiple videos and witnesses right? There was no gun. Thanks to the many people recording, we could, in principle, see all angles of the car. The police would be able to establish very easily if there were a gun.

If there were a gun, I would agree that his actions would shift to the realm of reasonable. I'll concede that. But, we can assume whether a gun was there or not would be established by the evidence.

no it seems to me he stopped his car and had no intentions of running any one over, and then suddenly did. as if he saw something dangerous (a deadly threat to his life).

this hypothetical is just an example of how this is not really an obvious criminal case.

It seems like to me as soon as he thinks she’s stepped or stumbles out of the way he gunned it and inadvertently got her with the side of his car.

Ok. Try running around shooting people and then tell everyone you believe they are carrying weapons and trying to kill you. See how that holds up. There have been cases of people using this, even in actual situations where they really thought it was a gun, and barring law enforcement, it almost always ends with the guy being held responsible.

Attempted murder has to show intent. I didn't see any intent in this video. Dude pushed her, stopped and gunned it. Didn't turn toward her, didn't back over her. No intent to kill.

I can buy that. But the way he accelerated could be construed as intent to run her over. Also, at the very least, it is assault and battery with a deadly weapon. He also literally did a felony hit and run.

She wasn't seriously injured and I don't think the guy was charged with anything.

Maybe I am too autistic to get this, but I was going 100% by what the law says. It isn't always enforced objectively.
