lmao yeah I noticed everyone thinking I didn't have one so I had to take a picture to save the time.

The thread actually helped though because originally I wasn't thinking about Porsche authorized since it was door replacement, but then since its being reported on car history it created a new world of problems but now I'm in the process of presenting the diminished value to the insurance company and likely being told to **** myself on 13k lol but if they meet me anywhere up there I will be happy, as I don't NEED to sell my vehicle, but if the event happens I will have that money to cover the difference.

I know I've personally pulled a car fox on multiple previously owned vehicles and pressured a private buyer to lower price. I've turned several cars down because of fender benders that they didnt have information/receipts about the damage. I dont see a scenario which this doesnt hit OP with devaulation. Any vehicle with a car fox report is harder to sell. Thats why there are dealerships that fix cars in house and dont report.

There is a healthy and thriving legal industry for taking insurance companies to court for depreciation..Why does the type of legal practice exist if there wasnt precedent for seeking/rewarding damages?

Thanks, it would have had to be an Audi R8, bmw m8, or jeep track hawk(dealers were marking them up 20k over msrp though) for my other options. When it came to personalizing and the electronics in the vehicle, for daily driving it is far superior than any other options I could have picked for a "Dad car" imo, that also has the performance of it(except maybe if I went Turbo S lol)

Not sure if it's been posted already but if you get your insurance involved they will also get diminished value $ from the delivery company/their insurance, in addition to whatever cost your call will take to fix.

Obviously that all involves you claiming that your car was damaged. However, it'll be several thousands of dollars in your pocket. Worth it.

Strong jealousy in the misc expect the penny hoarders to hate. I am sorry this happened it sucks trying to deal with insurances especially loosing a lot of time. I would be livid if that happened to my 18 S3 too

This is not being claimed through my insurance, the delivery company insurance will be handling things. They have the reporting procedures/regulations that it will be on my cars history. They are going to pay for the damages but it has not been seen that I will get diminished value for it, although I have now gotten an estimation for the value which is a 13k difference, so I will be waiting for a response on that.

lol yeah I don't get the hate, it would be one thing if this thread was not a (srs) tag or that I was making this to specifically talk about how much money I have or something stupid, but some came in with their pitch forks for no reason lol.

It definitely sucks, because I had no fault in this. If it was like a wreck or something i'd feel differently. The insurance hopefully wont be to much of a hassle but them starting off saying they are sending a check for 900.00 for initial work and paying per work to the shop, sounds like they are going to make things a lot more complicated then needed. Im not sure if they are doing this because they are worried I might just keep the money and not have it fixed or what.

not sure if it's been said yet, but when it comes to suing for diminished value, it doesn't matter what the insurance AGREES to pay, you are suing them because they are not making you whole, which is what the legal system is for. Your demand for repairs and diminished value is 100% in line and acceptable, especially with the hit and run aspect. I would send one final demand letter requesting full repair costs AND diminished value amount, IN FULL by a certain date otherwise your next step will be to file a law suit. Period end of story. You will 100% win, especially with correspondence of them admitting fault, AND with them hit and running...

Also LOL at thinking a threat of a made up deadline or an attorney scares an insurance company, they have a whole team standing by and they have state statues to handle a claim within which in most cases is up to two years. Play tuff guy and enjoy getting your claim pushed to the back of the line every week for a few months.



OP who gave that 900 estimate? Did you take it somewhere and have it done, did the insurance company send someone out to have it done? There’s no way that damage is 900. I’d suggest taking it to a reputable shop and having someone from the insurance company meet you there so all 3 can do a full estimate on it and they can get into it if needed to check behind the door ect. It is common for them to write an estimate on what they can see and rely on the shop sending and them paying supplements as the shop starts the work and can send in better damage pics as they go.

If you sent in the supports for the diminished value I’m sure they’ll look at it and get you an offer. Keep in mind that it’s not some specific number for the value because these are all guesses at what it’s decreased by so you’ll be able to negotiate with them. My suggestion would be to not be an asshat and threaten lawyer, you’ll get a lot more and quicker resolution if you come off as a nice guy that just wants to settle the claim and move on.

Also keep in mind they won’t even look at the diminished value claim until the repairs are complete.

They will be paying the repairs without a doubt, its going to be a long process likely as they are talking about paying the shops bit by bit for the work versus writing the estimation in full. They sent me a check for 900.00 im told, for the first repair and then will send again as the work goes along which in turn will likely slow things down because a shop is going to want to wait for the money I imagine, since its through insurance where they could decide they aren't going to accept a certain price for work.

I have however gotten a diminished value estimate of 13k, which I personally only was expecting a few thousand, but I knew it could be drastic for the cars value, because realistically no one is going to spend that much money for a car that has damage on report unless they can get a good deal on it even if it was only a broken mirror on report lol.

I have forwarded both estimates to the insurance so I'm hoping Monday I get a reply with if they are willing to pay that amount or if they want other estimates done or what, as I imagine they are probably going to want to see if they can pay less. Setting up taking the vehicle to the Porsche authorized repair on Monday and getting a rental through enterprise paid for by the companies insurance. If they for example offer half of that for diminished value, I would possibly be better off taking that than to hire a lawyer because I imagine lawyer fees trying to fight them would be a couple thousand over time, one lawyer told me(before I got a diminished value estimate) that his fee of 94.00 an hour wouldn't be worth me pursuing and never replied back to me after that. Probably will forward him the 13k estimate and tell him to smd for not attempting to do the job, as if I couldn't pay his fee if I wanted to lol.

So when you got in contact with them and you said hit and run were they like cool np or? Can’t your insurance strongarm them somehow in regards to hit n run?

It’s just a door, it’s a repair that shouldn’t take more than a few days even if they have to order a few parts....unless you for some reason took it to bobs corner repair shop.

Getting multiple estimates is worthless unless you make the insurance company send someone out to meet you at the shop you want the work done at so all 3 of you can go over the car. If you just send in random estimates they’ll tell you to get started off the 900 one they sent the check out for and have the shop send in supplements.

Insurance isn’t the police, the hit and run aspect doesn’t mean chit to them, they just process claims. My guess is the driver said he never hit OP so the insurance company had to investigate if they owe OP. If you present a claim to another insurance company you have to prove the other drivers fault/your claim or they don’t owe you anything. If their driver says he never hit OP that’s probably why they asked for witnesses and made OP line up his car to the truck to see if the damage matched.

its not a 900.00 estimate, its 900.00 that insurance is willing to pay at a time for the work. The insurance company has done nothing, I've been doing everything from getting all the estimates and etc, because it was a hit and run originally my estimates were with the mindset of me paying out of pocket and not reporting so that it would not be on my car history, since it was going to be a door replacement and I didn't think about things like if paint didn't blend properly(although original shop does specialize in it), and the fact that Porsche authorized repair will not use some of same parts or etc that another shop would use because they have set standards, I didn't originally use them. But I've cleared with the insurance I will be taking it to Porsche authorized, and they will start the work based off of the original estimate and add any additional findings and etc.


Yeah I'm not with the scare tactics versus a major company, I'm just hoping the fact that they have basically owned up to it being a hit and run, that they wont try to make such a big hassle about everything, because they are completely in the wrong and say for example I find out the driver wasn't fired then that would create a bigger thing and other fall back.


I was told that they would look at diminished value after the repairs and when an offer is presented, so I presented them with an offer for no damage and offer with damage from a Porsche manager at the top ranked Porsche dealer in my area. With the repairs done it wont make a difference on the managers offer because he took it with having damage reported on car history versus no damage reported if that makes sense. Now I don't expect them to just pay it out before repairs, along with they likely will want to drop it to atleast 40% of the offer for some shut up money lol. But if say I get estimates from 1-2 other Porsche dealers and they are basically the same range of atleast 10k diminished value, I don't see how they could not pay that, which if they didn't I would need a lawyer but as mentioned before that would come down to if the lawyer costs will end up basically me get the same amount as their 40% offer or not.

My car was hit on 5-17-2018, originally I had no idea who did it, then I went to touchless dent repair shop and they found brown paint in the scratches and my dents were so deep they said it had to be a big/heavy vehicle to cause that type of force. Then I remembered that my childs mother went downstairs to stop the dog from barking at ups truck making a delivery. A light bulb went off and when I filed police report(which did nothing) I then called the delivery companies distribution telling them I believed that their vehicle hit my car based off what the dent people told me and etc. The delivery company then ran an investigation because if drivers do hit and runs and not report they are supposed to get fired. They brought the same truck and driver out and played the I don't know how this could happen game, going over his routes and etc with me then lined up the truck and took pictures.

They then claimed they don't think they could have done the damage so I said I need to speak to the distribution manager and have them come out and line up the trucks. She came out and that's where I got the pic in original post of the rail beside my car and etc lining up, they still claimed they would have done more damage if they hit me, she even no **** pulled out google images of damage ups trucks have done to vehicles when hitting them and etc as if every case is the same lol. They forwarded the pics they took to insurance and I sent the ones I did with showing where damage lined up and etc.

I didn't know if they would ever take claim to it or not, but then last week their insurance called me and said for me to go get an estimate of damages from a shop, I did such at a place who doesn't report to history. Then today their insurance said they would report it on history so that opened up a new world of problems. I don't think insurance has much to do with the delivery companies policies because insurance is what pays out everything, im hoping they are just like welp the company screwed up and were paying the damages and however they charge the company they do that.

you seem to talk put your ass with most every post in this thread. I got rear ended once and all I had to do was take it to the shop of my choice and I discussed with them what was damaged and made sure oem parts were to be used. They finished the work in a week or less which was very reasonable with no hassles and they handled all payments to the shop.
The depreciation may go slightly different but the shop won't drag their feet, especially porsche place. They know the insurance company is liable and on the hook.

He maybe thrown off because he thought I was saying its 900.00 worth of work when I was saying that's all insurance will pay at a time versus writing a check for estimated value and then paying whatever else is needed. I was however quoted 9 days without including weekends from the first shop for door repairs, cant forget they also need to blend/paint things and whatever else processes are, but I'm sure Porsche shop will be a quicker turn around but higher labor fees lol but that's on the insurance company.

Highly doubt an inspection is necessary. If it's side collision with minimal damage, your insurance claims adjuster will more than likely have you send in pictures of the collision damage instead. Since it's a 185k valued Porsche, diminishing returns are in place for resell, especially when there's minimal damage. Very risky car to insure indeed. Did you pay for it in full op? With your 500 deductible you might be able to use that to cover expenses, since you weren't at fault that won't increase your premiums either. Just get rental reimbursement then fix your Porsche on your other parties tab (insurance).

100% Disability back pay can easily be over 100k. Still fighting the VA to even get my 70% :/. Not that im saying that's what op's situation is but just one explanation to get a large sum of money as a veteran.

My insurance is not involved in this at all, only the delivery companies insurance. Yes I paid for it in full, but again my insurance isn't involved in this. I originally was going to pay for the repairs out of pocket myself to not have it on car history because I didn't know if the company would pay. Then once they said they would I stopped thinking of that and now at the point where it will actually be on my car history from them paying for it, which I'm fine with IF I can get paid for diminished value as I didn't plan on selling it BUT in the case that I ever wanted to, I don't want to look back and think wow I really took several thousand dollar hit on my resale because of someone else's fault.

No you didn’t TELL them to use OEM parts your car either qualified for them based off year/miles or you went thru your own policy and had an endorsement for them because if you didn’t you aren’t getting them if there’s an alternate part available.
And NO the body shop isn’t doing chit without approval from the insurance company because if they do and the insurance company won’t pay for that specific part, or that specific labor rate, or they think it should be repaired in 5hrs instead of 8 guess who’s fukt?

OP I’ve never heard of an insurance company dishing out repair money 900 at a time. Are you sure you’re dealing with an actual insurance company and not some person at UPS trying to resolve it without insurance?

It is insane. I was medical out as well and rated 0%, then up to 30, and my attorney is working on getting 70% and TDIU. Been waiting on a hearing for two years... just a fuking hearing.. it's insane.

Do NOT cash any checks from the insurance company until you read every word in any release or statement that accompanies it. Sometimes they'll try to trick you into signing a full release for little money.

Yes I am dealing with insurance company claims representative. I also thought dishing out 900.00 check instead of at least the initial estimation was odd because I've had more paid out for a motorcycle repair through geico at once, but they also are not doing procedures I thought they would do like send out a person from their company to do the estimate or whatever, since I got the estimate at the shop myself and sent them the documents, maybe they are doing that small amount at a time so they I couldn't just have them write me a fat check and not get the repairs done or because the brand of the vehicle, they are expected damages to continue being higher. I specifically asked the claims representative why are they doing 900 and he said it was their policy, and I asked if I could possibly pay out of pocket upfront from the 900 and be reimbursed so that I wouldn't possibly be waiting longer for repairs if they have to keep doing back and forth sending a check but I was told because insurance gets certain discount or set price for work done and etc they would not pay the difference if the shop charged me more for anything compared to them.

Maybe 900 is the intial check they sent me and since they will be dealing with Porsche directly from there on out after its in the shop, then maybe they will pay them in full because its not the same as writing a check and sending to me?

Because their insurance is at fault, if they are agreeing to pay the damages I don't see why I would need to get my insurance involved as im not going to be paying any deductible or etc because my insurance wont be covering any of the damages?
I currently do not need a lawyer because they are paying out for the damages, a lawyer would only be needed if they are against diminished value claim, to my understanding. One lawyer told me he charges 94 an hour, this is going to be like a 1-2 week repair, would be pointless to be paying a lawyer now if I do not need one, and if the lawyer fees end up being anywhere near a couple thousand, its likely going to be what they'd offer me in diminished value after the case. For example, I got estimate of 13k diminished value, but they offer me 6.5k. I could get a lawyer and try to fight for the 13k, but then lawyer and court fees(?) ends up costing 4k, I would have likely been better off just asking to be met at 7-7.5k and not had to deal with all the hassles I will have to with trying to fight them.

I believe being separated with 30% is retired, I originally got out with 60% but that was just for my specific injuries that made me unfit for duty, then I had to go to the VA and get up to 80, but they also screwed me on several things like TBI, they rated it under combat related ptsd, so that they would not have to give me 2 separate %'s which would have gotten me to 90 or 100. yeah the system is such a joke, my father boxed in the Army for 8 years and tried to say his brain damage was not related to that, even though back then people were taking blows to the head like a rocky movie and there was no research and etc on it. Hes been fighting it for over 3 years.

To my understanding its just going to be a 900.00 check with no other paper work or etc, but I appreciate it I will definitely take a look at everything because I do know big companies can be shady and insurance always wants to pay out the least possible and cheapest repairs for example.

OP who gave that 900 estimate? Did you take it somewhere and have it done, did the insurance company send someone out to have it done? There’s no way that damage is 900. I’d suggest taking it to a reputable shop and having someone from the insurance company meet you there so all 3 can do a full estimate on it and they can get into it if needed to check behind the door ect. It is common for them to write an estimate on what they can see and rely on the shop sending and them paying supplements as the shop starts the work and can send in better damage pics as they go.

If you sent in the supports for the diminished value I’m sure they’ll look at it and get you an offer. Keep in mind that it’s not some specific number for the value because these are all guesses at what it’s decreased by so you’ll be able to negotiate with them. My suggestion would be to not be an asshat and threaten lawyer, you’ll get a lot more and quicker resolution if you come off as a nice guy that just wants to settle the claim and move on.

Also keep in mind they won’t even look at the diminished value claim until the repairs are complete.

They have already admitted fault. If they are unwilling to the terms op gives (which are 100% acceptable and right) and want to drag it out, he has EVERY right to sue. OP does not HAVE to go through their insurance. He can sue the company/part at fault directly, and then they would have to seek reimbursement from their insurance. Putting the deadline in place establishes a reasonable timeline for the responsible parties to act.

as for state statutes, yes, but again you fail to understand that op doesn't HAVE to work with the insurance company. OP has a time frame he has to file within, and the party at fault has a time frame to respond within to avoid a default ruling. By op giving a deadline to comply, he is merely giving a courteous opportunity to the insurance company to take care of their client. If they fail to comply, he has every right and ability to file a law suit against the responsible party directly.
