The report says he didn't get violent. That's why the marine is charged.

It's going to boil down to the witness testimony, and how long the marine kept his hold after the crackhead stopped trying to break free.

Earlier reports said other passengers were threatened by the crackhead, and they did notthink the marine was restraining him hard enough to kill him.

This is the first I heard about someone warning the marine he could kill him.

This is a fcked up charge. I think there's a lesser offense, like involuntary homicide or something, where the one accused didn't know he could have killed the victim. And that's what I believe the marine was saying, so it's odd that they charged manslaughter. The prosecutor has to convince the jury that either the marine knew prior to choking him that he could kill him, or during the 2 minutes he ignored passengers warning.

Really need to see the entire video.

It sucks because the marine didn't have intent. Otherwise they would have charged murder. And apparently only lasted 2 minutes. Unless the marine is a black belt in jujutsu, I don't think he was negligent. I think he simply tried to restrain the crackhead who was threatening, was acting in self defense, and this was a total accident. My view can change, but this is where I stand based on the reports I've read on the incident.

This was a high adrenaline situation so I'm not sure what his face says to you. To me it looks red, like I would expect.

The crazy guy probably should've been institutionalized. 50 prior arrests? What were the charges? How was he still roaming about after 50 separate criminal offenses?
At the same time, the Marine probably should've let go a bit sooner.

So society has two options: Either let crackheads become agitated and violent and wait for them to possibly harm someone innocent until "authorities" arrive or step up and protect innocents and then go to prison. What a world. What's even funnier is even if everyone waited for the "authorities" to arrive even the authorities would be on the hook for the same sht anyways. It's all too fuked and too far gone. Can't protect yourself. Can't protect others. Those responsible for protecting still get cucked anyways.

Don't agree with this. Anyone who's used public transportation at some point in their life has dealt with this. The marine is the one who got physical, that was his first mistake. His second was putting a chokehold on someone for minutes.

I think you have to try to avoid the threat first. Like if someone walks up to you on the street and says they are going to beat you up, you can run away. But if you are in a train, which is a closed and tight environment, making a pre-emptive strike against a threat is self defense.

The question is how much physical force was warranted to deter the threat? Definitely not lethal force. But if he didn't kill him, and let's say he just left him unconscious, should the marine have gotten charged with assault? I don't think so. Other passengers on the train said they also felt threatened by the crackhead. So he acted in self defense of himself and of others, but he obviously took it too far.

It was reported that the crackhead was throwing things, not sure if on the floor or at people, but he was acting hostile and threatening towards passengers. Physically restraining someone like that on a train is self defense.
