Marine vet going to Jail for holding crackhead in a chokehold

On May 1st, Neely, 30, a Michael Jackson impersonator who suffered from mental illness, was acting aggressively and screaming at other passengers – but hadn't attacked anyone, according to a freelance journalist who recorded the deadly confrontation.




Penny, 24, pulled Neely to the ground from behind and held him in a chokehold as two other men helped restrain the agitated man. Neely initially flailed his arms, but within minutes, can be seen going limp in the disturbing footage.




At one point, a fellow rider can be heard in the video telling the men that it looked likeNeely had defecated on himself (usually u crap yourself when u die)and warning them to be careful not to kill him.




The Fire Department said it received a call for help at 2:39 p.m. and arrived on the scene seven minutes later.

The city's medical examiner said Wednesday that Neely died from compression of the neck.

Now, Daniel Penny is expected to turn himself in to police on Friday morning to face a manslaughter charge.

"We can confirm that Daniel Penny will be arrested on a charge of Manslaughter in the Second Degree," a spokesperson for the Manhattan District Attorney's Office said. "We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow."

This is an instance when I think the "Social Justice Warriors" are correct. That was a criminal act. You can't sneak up on a man and choke him to death because you think he is a nuisance and you want play hero. People are fed up with the crime but that does not justify a guy being choked to death because he was behaving disruptive, by a stranger looking to impress other strangers.

No, they are never in the right.

They are trying to destroy society so they can attempt to rebuild it the way they want it. A main way to do that is protecting criminals and demonizing anyone that dares defend themselves against them.

This. There not only is zero reward for trying to help defend others from violent people, law it self will most likely punish you for trying to save others. Our society is f***ed. This isn't a george floyd situation where a *police officer* was restraining a man who was acting erratic (and then the man died of an overdose).

This is an act of a vigilante who restrained a man (who had not yet put anyone else in imminent danger) in a negligent matter and that directly caused the dude's death.

What to do about these wild astronauts is a different discussion. The answer is probably that everyone who is not about that life probably needs to leave and form their own colony. But the answer def is not that we just go up and chokehold astronauts or anyone else for that matter just because they are aping out.

Damn that really sucks. If other passengers were telling him to be careful not to kill him, then this guy is going to have a tough legal case.

2nd degree manslaughter implies that he knew he was using lethal force. So he's going to have to prove that he did not know he was jeopardizing the crackheads life, but if bystanders were warning him, that just really sucks for the marine.

Hopefully he gets a good lawyer.

He wasn't a perfect human being (no one is), but he didn't deserve to die at the hands of that scumbag. There were even other cops around, dude wasn't gonna go anywhere.
