Nothing is going to happen. We have people bring in fake Rolex's to try to sell/see if its real/or get a battery for all the time.

As for the stolen one…we've had the police called on someone selling one we knew was stolen, from a customer of mine actually, and pretty much nothing was done. They just say they bought it off so and so and didn't know it was stolen and to my knowledge that's all that ever came of it unfortunately.

lol @ it being illegal to possess a fake watch. So if someone creates a replica Ferrari kit car with Ferrari badges, they're going to be arrested? What about all the women with fake high end purses? Fake brand name sunglasses?

The crime lies in the trademark infringement of the company/person manufacturing the fake watch and using the Rolex/Tag/Breitling/Patek logos on their products, not mere possession of a replica by an end user. You absolutely can privately sell the replica Patek legally and disclose that it is a replica.

It is still illegal to posses, it's just more effective cost/benefit wise to hit the companies/manufacturers.

Same thing with uploading/downloading movies illegaly, buying/selling drugs plenty of other stuff. Take away the supply, which is also where the profit lies, and you'll end up with no fakes.

If you have a business devoted to selling fakes, then YES, it is a crime. If you are manufacturing and producing fakes, then yes, it is a crime. But to simply possess a fake watch you obtained through an estate sale is not a crime.

Law enforcement bases its investigation and prosecution of this type of thing on trademark infringement which is codified in 15 U.S.C. 1114. It states:

(1) Any person who shall, without the consent of the registrant

(a) use in commerce any reproduction, counterfeit, copy, or colorable imitation of a registered mark in connection with the sale, offering for sale, distribution, or advertising of any goods or services on or in connection with which such use is likely to cause confusion, or to cause mistake, or to deceive; or

(b) reproduce, counterfeit, copy, or colorably imitate a registered mark and apply such reproduction, counterfeit, copy, or colorable imitation to labels, signs, prints, packages, wrappers, receptacles or advertisements intended to be used in commerce upon or in connection with the sale, offering for sale, distribution, or advertising of goods or services on or in connection with which such use is likely to cause confusion, or to cause mistake, or to deceive.

So paragraph (a) talks about using a counterfeit in commerce, meaning a business or trade scenario, not a private person to private person exchange. It also talks about using the brand logos to cause confusion or mistake, which is why I said that he must disclose that it is a replica.

Paragraph (b) again talks about how it is illegal to use trademarked brand logos in the manufacture of goods, etc. So therefore the crime is being committed by the producer/manufacturer, not the end user. The essential element is "intended to be used in commerce." This means you can take an Invicta that looks like a Rolex and switch out the logos at home all you want, as long as you don't set up shop and pass it off as a real Rolex.

Please provide a source where anyone has been arrested for possessing a fake watch. It's more effective to hit the companies/manufacturers because they're the only ones actually committing a crime.

How hard is it to adjust a rubber band? Someone said cut the links?! But I don't feel comfortable doing that. How would one adjust a rubber band when buying online?

If its like this one, it looks like you'll have to cut it. If it's anything like a Breitling I have, there are already lines on the inside of the bracelet that show you where to cut. Just get a sharp knife and go one link at a time and its not very difficult.

During a crackdown in Italy earlier this summer, a tourist was fined 1,000 euros (825) for buying a fake Louis Vuitton bag for seven euros (6) from a vendor at the resort of Jesolo, near Venice.
You are right though, possession is not punished in Belgium either apparently. Unless you buy it from outside of the EU in which case you can be prosecuted for it.

I had it done by the guys I bought the strap from. Any shop that sells watches apart from your local supermarket can do this and some may do it for free.

If it were me and I didn't trust myself, i'd be sure to take it to an AD, since they could easily order him another one if they fuk it up. It's not difficult to do, but you never know how willing some random place would be to rectify the situation.
