The idea the 14th protects birthright citizenship was only 5-4
What the eo did was create this case to see where we stand on the 14th.
Before this people laughed at the fact that birthright citizenship might not be covered by the 14th.
Now we realize we are 1 vote away with instructions to a next possible court from Gorsuch / Thomas- and in part Kavanaugh on how to do so.
Justice's stance on this during nominations can become the new litmus test like roe wade used to be.
We've gone from this idea, being laughable to one vote away from realistic.
