its common sense to always have your hands visible and in the front, and stay low as much as possible so that your back is visible as well, slow controlled movements
kneeling position does not mean you have to jump up in 0.1s. flailing your arms around also does not work well.

IMO cop escalated this with a hostile & condescending tone and doing way too much talking. Even if kid was armed (no evidence he was) & you want to be damned sure of your safety, hold him at GP and calmly tell him not to do anything stupid and at all times keep his hands on the ground. Not sure why cop wanted kid to "crawl" towards him either if the point was to get hm close enough to cuff him. If so then walk over to him and do the job. Yeah he might have a gun or he might not but that's part of the job sometimes. Kid probably made a split-second decision to pull his pants up or something and with the cop's tactics that probably cost him his life.

How much police brutality do you think goes on behind the scenes? No officer I know would let another officer do sketchy illegal chit and just turn the other way... that's not how this works. If an officer screws up and does an honest mistake, they're called out. If the problem persists, they probably won't make it past their probationary period (18 months). If an officer does something outright illegal, they're fired. I know first hand of dozens of officers that have been let go before their probationary period is over for making poor decisions. I know of 2 that have been fired for doing illegal things on duty. No one tried to cover for those officers, it was their decision to act poorly and no one was going to risk their own careers to save someone who shouldn't be working there in the first place.

Doing what the cop asked really isn't that hard to do. If he would have simply followed instructions he would be alive today.

People on here are acting like this cop wasn't scared for his life. He was and he was therefore probably nervous as hell. Mistakes happen all the time in these situations. The cop obviously handled the situation very poorly but to call it murder is way off.

If they do something illegal as a cop you belong in jail not unemployed.

Where were these good cops, in this hotel, or when Eric Garner was choked to death, or the zillion other murders by police?

Both of the officers I know who were fired for illegal acts were also arrested and jailed.

Ask the grand jury who didn't indict the officers in the Garner case. Also Garner resisted arrest, had multiple arrests in the past for assault and resisting arrest, and the autopsy said his obesity, heart conditions, and asthma also contributed to his death, no actual damage to his airway was found.

That "You're fuked" stamp would absolutely 100% not be okay to have at any department I've been a part of. Different departments, different policies, but I agree that's unprofessional.

One of the issues is training. The US has over 16,000 different law enforcement agencies. I visited Wichita Falls, Texas once. One day walking to the gym I went past the university, there'd been a bomb hoax call or email or something, the whole place was sealed off. Present at the scene were,

Would they even need permanent instructing staff? So how high would the standards really be? There's going to be some really good, sensible, experienced cops - but with 16,000 different agencies and literally thousands of different training establishments (some overlap and train each-other), they won't be able to pass their experiences on.

Part of it, too, is the sheer number of people involved. The US has over 700,000 police. It's the same as with a military - if you want to recruit zillions of people, you're going to have to lower standards of entry and training.

Meanwhile in Australia, each state handles its own policing, with one academy each, and we have a federal police academy. You seem similar patterns in other countries. Thus: adjusted for population, the US has 4 times the homicide rate of Australia (and it's not just guns, take away all firearms homicides in the US but leave them in Australia, and the homicide rate is still 50% higher), but their police arefifteentimes more likely to kill someone.

Very unprofessional and I would like to add I think the cop handled the situation very poorly but again, I don't see murder.

From what I've read, the guy was a pest exterminator and had 2 pellet rifles in the room.

They were drinking with another guy who was previously with them and he wanted to see the scope and pointed it out the window. It wasn't pointed at anybody, but someone in the hot tub saw it and decided to tell the hotel staff, who called the police with a simple 'man with a rifle' call.


Instead of the responding PD simply first calling the room for the 'suspects' to come to the front desk, and it could have been sorted out there, they decided to 'get it on' and went full SWAT like it was an active shooter.

From there on, it went downhill as the cops set themselves up to the edge with all the screaming and conflicting orders. The 'suspect' was intoxicated, and made an instinctive move to pull up his falling shorts as he was crawling and crying not to shoot him. You could even see nothing was in his hand before the officer fired. The other officers didn't fire, only the one, and the other officers even said they didn't feel threatened by the guy, which is why they didn't fire.


Absolute chit show that tax payers will have to pay for now.

Well, the other officer made mistakes to... he didn't pull correctly and he said clear when he didn't clear. Clearly rookies and I guess the one with the gun wanted to prove he's about that training life except it ain't training fam and he shot a citizen.

Legally, it’s not enough for an officer to show that he was actually afraid for his life. He has to show that “a reasonably prudent person” would also have the same fear. Clever defense lawyers twist this standard into a line of argument that goes something like this: The officer was afraid, and he can explain to you the reasons why he was afraid. Therefore, it was reasonable that he was afraid. But real fear isn’t always reasonable fear.

That’s especially true when the police — through their own incompetence — create their own fear. Philando Castile was shot even as he followed his killer’s instructions. Shaver died trying his best to comply with a highly unusual, complicated set of commands while under extreme duress. Scared cops still need to be competent cops, and members of the public shouldn’t face death because a police officer can’t keep his emotions in check.

Police have a dangerous job but they are not at war Arizona law defines second-degree murder as killing a person without premeditation “under circumstances manifesting extreme indifference to human life, the person recklessly engages in conduct that creates a grave risk of death and thereby causes the death of another person.” In this instance, the charge fit the crime. The jury’s verdict was a gross miscarriage of justice. My heart breaks for Daniel Shaver’s family. May God have mercy on his soil.

you cant give someone all these stupid instructions, the kid was scared chitless and probably high and/or drunk. he was face down with his palms on the floor. that's more than enough to safely cuff him.
Great point that he could have been drunk or high. The instructions were absurd even for me, sober and calm at my computer. Put your hands in the air, keep your legs crossed, crawl towards me? Just lol. Da fuk is this guy talking about? You can see the first person doesn't crawl, she walks on her knees with her hands in the air.

The key moment is really when the guy accidentally uncrosses his legs, get's screamed at by an unstable man with a rifle trained on him. Then intrinsically puts his hands behind his back and gets screamed at again. He moves his hands in front of him because he realizes he did something wrong, but doesn't put them in the air until the second command because they are screaming to the point of complete incoherence. Handled like chit by officer badass.

The dude that got shot had basically given up because the cops were handling it so absurdly. They get done telling him to never put his hands down and then tell him to crawl towards them and he literally tilts his hands like "dafuqqqqqq???" as he puts them down. You tell 1,000,000 people to crawl somewhere and 1,000,000 people will all put their hands on the ground.

Also, his empty hand is clearly visible before the first bullet flies. Completely chit policing. I could see no murder charge, but 100% cop should be fired, head of department fired. Entire staff retrained by new head of department that doesn't have officers sending 5 bullets through unarmed citizens and hotel floors.

The fact that this was 2nd degree murder is absolutely unarguable those who say otherwise are getting innocent people with families killed.
