Exactly. It’s not like he’s immune from arrest later if they decide it was criminal.

“Hey, we know this is an apparent self defense case, but you’re going to have to sit your nearly 80 year old ass in jail and get an arrest on your record.”

It could be decided that his use of force was a disproportionate response and he would be charged, who knows at this stage.

The point is that a burglar should relinquish their protection under the law by breaking and entering, and so you should be able to go HAM on them, but here that's not the case unlike most places in the USA.

How are we expected to act in this situation? Armed invaders in your house and you're meant to show compliance? Hoping they're not too mentally unstable to hurt you (knowing they're already mentally unstable for breaking in to your house in the first place).

I have a knife under my bed in case anything like this happens...come at me UK legal system

WTF was he supposed to do, ask the home invaders to leave his house nicely and then wait to be stabbed first before he does anything? If he gets stabbed first is he only allowed to stab him back an equal or lesser amount?

Does anyone else notice the article goes out of their way to not to mention the race of the home invaders or their name which might give away their origin?

The extent the contact police should have had with this dude is a fist bump to say thank you for handling this piece of chit before we did.

I don’t care if they let him off without issue...the fact the word murder is even uttered is dumb as fuk.

Chit, the state I’m in has a castle doctrine that allows you to fill someone with bullets if they even attempt to cross the threshold of your front door. Shoot them in the back as they attempt to run...no problem and if they are found to have been committing a crime in the process...their family can’t sue in in civil court.

Since when did "being arrested" (ie being detained by police) equate to "sent to prison for murder"? It's a formality that has to happen in order for the investigation to take place the right way. If he were convicted that's different but I very much doubt it would even get so far as a court room.

Don't all be so quick to comment or disapprove before knowing all the facts.

But buy the man a beer, and then buy him another one - good for him for sticking up for his stuff.

"A 78-year-old man has been arrested on suspicion of murder after a suspected burglar was fatally stabbed at his home in London".

Suspected murder, suspected burglar.

Ill give an example from a story i know. People were having a party, guy turns up and barges his way into house, fight ensues. Guy who broke in is stabbed and stamped to death (skull all broken)
Turns out, guy never broke into the house, was already at party. Some drunk guy got pissed at him and murderd him.

Guy spent 6 years in prison... yes 6

But of course the person has to be detained and quesitoned. The police cant be like "GJ old brah, gimme a high five"

it's interesting how misc is one of the only place where this article isn't taken down. it's not on reddit anywhere and NO major newspaper website is enabling comments. even dailymail has disabled their comment section.

And that's how it should be, there's no such thing as disproportionate force when your family might be in danger.

BRB arresting someone as a formality, the fact that people ITT are defending this just proves that cucks are taking over.

This.

It's fuking disgusting. This old man spent 2 nights in jail for defending himself/his wife/his home, meanwhile the actual criminals (the accomplices) are free.

This country is a cesspool and an embarrassment.

Guess the UK doesn't have that innocent until proven guilty thing, I guess it's backwards for your duck face making cuck of a country. Guilty until proven innocent.

If you're the average "man" in the UK, it's no wonder that Mohamed is taking over.

Save your breath fella. Anyone who can't comprehend why he was arrested isn't worth a reply.

I'm honestly dumbfounded by some of these replies.

Sad to see the response to this by my pathetic neutered compatriots. There is no need to arrest the man unless it turns out upon further investigation that everything was not as it seemed to be. Please read the following.
The frequent arrests of people for defending themselves or their property are not accidents or quirks. They are the consequence of the Criminal Justice system's abandonment of old-fashioned ideas of punishment; also of that system's social democratic belief that crime has 'social' causes and the ownership of property isn't absolute. Most law-abiding people don't really accept this. They think criminals do bad things because they lack conscience or restraint, not because they were abused as children or their dole payments are too small. And they don't see why they have to barricade their houses or hide their worldly goods from view on the assumption that some unrestrained low-life is otherwise bound to steal them. So they regard it as legitimate to hurt and punish those who rob them or otherwise attack them. If they were allowed to enforce the law as they see it, they would quickly show the police and courts up as useless and mistaken. One of the most important jobs of the police is to stop us looking after ourselves, in case we do a better job than PC Plod.

Americans are not so infantilised as we are. For many reasons, mainly the fact that it is still possible to live genuinely rural lives in large parts of the country, Americans are less likely to rely on others to protect them or their homes from danger. This used to be true of us too. It's evident from a lot of English fiction, written not for propaganda but by people who simply recorded life as they understood it, that until quite recently we had a more American view of things. In fact until 1920 English Gun Law made Texas look effeminate. Read, as nobody now does, Captain Marryat's 'Children of the New Forest' set in the days of Cromwell, and observe the wholly different attitudes towards self-defence against crime that are casually described there. Read, as fewer and fewer people now do, alas, the 'Sherlock Holmes' stories, and see how often Holmes and Dr Watson venture out carrying firearms. This was perfectly legal, and unsurprising, in the late Victorian and Edwardian era in which the stories are set. And pre-1914 attempts to control guns were resisted by MPs much as the US Congress resists them now.

strong morons ITT.

You realize that in the US, you can still be arrested for defending yourself, right?

The police don't know if it was in "self-defense". As far as they're concerned, you just committed murder.

I think we are all aware of the difference. As long as it is something that once he is cleared the arrest is removed from his record, etc. and there is no reference to him legally if it ever happening.

The concern isn’t for him at 78...what if you’re 23 and this follows you for life?

Disgusting. What else is there to say? Punish people protecting their home, allow foreign cultures to dictate your laws and own culture. Your home is supposed to be the only place you go back to feel safe. Someone enters, a criminal, you have to assume your life is in danger. The minute you break into someone's sanctuary is the minute your life is forfeit. Cops running around with tasers, boys wearing skirts in schools, the list goes on. Criminals and far liberals all need to be shipped to one land mass.
