There is such a thing as lifetime alimony. Paid until you fukken die. Actually used to drive by a billboard some dude bought and designed to look like a coffin for the purpose of campaigning to end lifetime alimony.

Many times when you sell a business you have a non compete agreement. I guess we found someone dumb enough to buy a business without one.

if you've never had to experience the US Family Court system you have no idea how bad it is. you have no rights in this court. if you can't afford an lawyer then to bad for you. you have no right to a jury and the judge is the ultimate unchecked authority on everything in the case. it's probably the most unconstitutional system in effect in the US.



another example. guy at work had his wife leave him for another man in Florida. they had 3 kids. she was married in Florida and preggo BEFORE they got divorced in Ga. if it wasn't for the judge being a man and noticing the math didn't work out per her testimony my coworker would have lost his kids and had to pay her child support. however he is still stuck with her $40K in student loans which he is taking up with the loan agency and might get that taken off his credit. but also $30K+ in credit card debt that she got by FORGING his name on the application. He never even knew about the credit card debt until the divorce started.
p.s. she doesn't even want the kids.

I don’t be leaf this story. Alimony is based on the disparity between two incomes. You can not be forced to pay alimony if you have no income. I have been divorced and I waived alimony even though I was eligible for it. If my ex did not have an income I would not have been eligible for it in the first place.

I don't believe a court order can ask you to sell a business. I assume he needed cash (because you said the personal account was bankrupt), and he had to start handing over some wealth.

Fully willing to admit that some people get screwed in a divorce. However "taking your money" isn't quite how it works.

If you have assets prior to marriage and you want to keep them separate you can do that, but you have to be purposeful about it. As in those assets can never be legally entangled with shared assets. And in some cases it might even be worth getting said asset out of your name and into the name of someone you trust if it is that big an issue.

All debts and assets accrued during the marriage are considered shared. The two exceptions in my state are inheritance (presuming said inheritance is held separate from family assets) and student debt unless there is proof said debt was used for family expenses.

These two exceptions make sense to me. Especially the student debt one.

So sounds like your step-mom was just not willing to be fair/reasonable. That sucks and it really didn't have to go down like this. Don't know why they couldn't have agreed on a valuation for the business/valuation for the house and put a total number on it. Then if the business was valued higher your dad could have paid that out as a settlement over 10 years or something w/balance to be paid to her heirs if she passed before it was paid out.

This other story - he should totally fight that. Don't know how he got saddled with her student debt if she got it in her name. If she forged his name on credit card applications I think he would have grounds for criminal charges. If that is so he could file charges to get the debt moved to her or get her imprisoned. At the least it would give him serious leverage if he wants to have custody of the kids. If she really doesn't want them she might be willing to sign over custody to him and give up the child support in exchange for him not pressing charges on the forgery.

Look dude, I really hope you and yours never go through this sort of meat grinder. Lots and lots of guys do, and the majority of them are decent guys who haven't done anything to warrant the level of vitriol with which they are treated. People make mistakes in choosing a partner because we are after all emotional creatures, your callousness and support of the idea that this system is just and these men are 'getting what they deserve' is honestly sad.

there is some bullshyt being thrown around in this thread.

a. first one is the forged credit cards taken out. i knew a guy who had that done by a business partner of his. he took out loans and credit cards in his name by forging the signature.

he asked the court for proof it wasn't him, and paid $250 for a signature analysis. judge accepted it as proof and let him off the hook for all debt.

b. alimony doesn't get paid out like that. the person awarded alimony doesn't get "everything" the other person gets. you get a payment based on your needs minus your own income. if the person paying has no income, he/she pays no alimony. this is a court form that can be filled out and applied for.

c. a cash heavy business was valued high enough to be sellable for a large sum? how? your father's an idiot for not claiming the expenses better, over reporting, or straight up lying to his ex on how much he made. looks like he needs a better accountant.

d. your dad got divorced twice. something ain't right with him either.

e. as someone said, at 65, how much did she want in money to live it up? at that point, most of us gave up on life. something else is wrong.

f. your dad should've given you the business, or at least a stock certificate for 99% ownership or something.i'm guessing he had red flags enough before she filed for divorce. goofed once again.

g. jake's on your dad for giving your stepmom access to money. my wife doesn't work, i give her an allowance (don't worry, it's ample, enough to pay the mortgage, pay off her student loans in full, buy all groceries, and few hundred dick around dollars a month extra), but all "extras" i put away into retirement, investments, etc. luckily, i didn't marry a money thirsty kunt cuz she already came from money so she lols at my poverty, but we love each other and live simply.

now, i'm not taking the step mom's side at all. it's gut wrenching that this happened to you and your pops, and i can only imagine the havoc it's wreaking on your lives. but the second she filed for divorce, you were not coming out as a winner. find the quickest path to resolution and give up as much as you need to to get on with what's left of your life, because the lawyers would milk it forever.

OP , you sound like a hard working intelligent dude, just go out on your own and learn from your dad's mistakes.

g. jake's on your dad for giving your stepmom access to money. my wife doesn't work, i give her an allowance (don't worry, it's ample, enough to pay the mortgage, pay off her student loans in full, buy all groceries, and few hundred dick around dollars a month extra), but all "extras" i put away into retirement, investments, etc. luckily, i didn't marry a money thirsty kunt cuz she already came from money so she lols at my poverty, but we love each other and live simply.

now, i'm not taking the step mom's side at all. it's gut wrenching that this happened to you and your pops, and i can only imagine the havoc it's wreaking on your lives. but the second she filed for divorce, you were not coming out as a winner. find the quickest path to resolution and give up as much as you need to to get on with what's left of your life, because the lawyers would milk it forever.

I don't believe a court order can ask you to sell a business. I assume he needed cash (because you said the personal account was bankrupt), and he had to start handing over some wealth.
He grew up in the industry with his dad but more so than I did. I came into it in my mid 20s while he was working for his dad when he was a kid.

bankprut is a strong word that I didn't use. there is a little money that was in their account but that was just basically enough to get by for a few months. but retirement funds were 0.

So sounds like your step-mom was just not willing to be fair/reasonable. That sucks and it really didn't have to go down like this. Don't know why they couldn't have agreed on a valuation for the business/valuation for the house and put a total number on it. Then if the business was valued higher your dad could have paid that out as a settlement over 10 years or something w/balance to be paid to her heirs if she passed before it was paid out.
basically this. she wanted no part of fair and easy and that is pretty close to what he was offering from the start. once this started he just wanted it over so he could move on. so much for that.
This other story - he should totally fight that. Don't know how he got saddled with her student debt if she got it in her name. If she forged his name on credit card applications I think he would have grounds for criminal charges. If that is so he could file charges to get the debt moved to her or get her imprisoned. At the least it would give him serious leverage if he wants to have custody of the kids. If she really doesn't want them she might be willing to sign over custody to him and give up the child support in exchange for him not pressing charges on the forgery.
he's pretty confident everything will work out for him in this regard. but odds she ever gets punished for anything is slim to none. it's already illegal to be married to more than one person and there is ironclad proof of this happening with her that was revealed in court.

You might be thinking, "well that's not so bad. splitting everything after almost 30 years isn't the worse thing. what is this yahoo talking about?".

so not only is this 63 year old man forced to sell his business but he has to pay ALIMONY for the rest of his life. of course he has no job now and the market for 60+ year old former business owners isn't exactly in high demand. so essentially unless he can earn an income to pay his expenses and alimony she'll be effectively getting everything minus what he spends before he dies.

that's right folks. she stripped him of his way to earn a living and she's getting paid for it. No income plus paying alimony. he gets screwed out of his life's work/savings and I have the last 10 years and my future plans burnt to the ground with nothing to show for it. all because of the feelings of a woman.
